İSVEÇ ANAYASASI ÜZERİNE NOTLAR

Abstract

İsveç anayasası, tarihsel arka planı nedeniyle dikkat çekici özellikler

göstermektedir. Yavaş, uzun süreli, istikrarlı ve barışçıl bir evrim sonunda

bugünkü nihai halini almış olan İsveç anayasası, anayasal statüye sahip dört

hukuk metninden müteşekkildir. Bu metinler arasında içerik olarak gerçek

anlamda anayasa olarak nitelendirilmeyi hak eden ve bu nedenle anayasa

bloğunun omurgasını oluşturan belge 1974 tarihli Regeringsformen (R.F.)’dir.

1974 tarihli R.F., İsveç devletinin temel niteliklerini, temel hak ve özgürlükleri,

yasama, yürütme ve yargı organlarını ve bu organların görev ve yetkileri ile

birbirleri ile olan ilişkilerini düzenleyen hükümlere yer vermektedir. Bu hükümler

klasik anayasa doktrini açısından değerlendirildiğinde içerik olarak benzersiz

düzenlemeler getirmektedir.
