Bireyler, vatandaşlığını haiz bulundukları devletten, haklarının korunması ve gözetilmesini hukuki anlamda talep edebilme hakkına sahiptir. Vatandaşı olduğu devletin bu korumayı sağlayamadığı durumlarda kişi için uluslararası koruma devreye girmektedir. Başka bir ifadeyle, uyruğunda bulunduğu devletten bu korumayı elde edememiş, hatta aksine kendi devletinden ciddi zulüm göreceği korkusunda olan kişilerin, bu korumayı uluslararası toplumdan veya başka bir devletten talep etmesi söz konusu olabilmektedir. Günümüzde uluslararası korumaya en çok ihtiyacı olanların başında ise mülteci ve sığınmacılar gelmektedir. “Mülteci” ve “sığınmacı” kavramları arasında bir ayrım olmasına rağmen bu iki kavramın zaman zaman birbirine karıştığını söylemek mümkündür. Nitekim Türk ve Rusya Federasyonu toplumlarında bazen her iki kavram yerine de mülteci kavramının kullanıldığı görülmektedir. Fakat mülteci ile sığınmacı kavramları benzer nitelik taşımakla birlikte, hem Türk hem Rusya Federasyonu hukukunda belli bir ayrıma tabi tutulmaktadır. Bu ayrımın her iki hukuk açısından ortaya konulması ise çalışmamızın amacını teşkil etmektedir

Individuals have a right to demand for ptotection and eye of their rights
juristically from the state they possess their citizenships. When the state
which they are a citizen of can not supply this protection, for the person
international protection steps in. In other words, for the people who have
nationality from the state and can not get this protection and for the people
who have fear about being depressed this protection may be demanded from
international community or from another state. Nowadays, people who need
the international protection at most are refugees and asylums.
Although there’s a difference between refugee and asylum concepts,
actually it is possible to say that these two concepts are confused with each
other. Thus, it is seen that in Turkish and Russian Federations sometimes
instead of these two concepts, refugee is used. But although refugee and
asylum concepts have similarities both in Turkish and Russian laws, they are
subjected to a certain difference. Presenting this difference in terms of these
two laws forms the aim of our study.
