Hava-Uzay Araçlarının (Aerospacecraft) Hukukî Rejimi

Öz

Havacılık ve uzay teknolojileri birleştirilerek, yüksek hız ve irtifalarda
işletilmek üzere tasarlanan ilk hava-uzay araçlarının test uçuşları 1950’lerin
sonunda başarıyla sonuçlanmıştır. Bunun yanında, NASA tarafından
1980’lerde benzer fakat daha gelişmiş özelliklere sahip uzay mekiklerinin
uzay misyonu çerçevesinde işletime konmasıyla hava-uzay taşımacılık
sistemlerinde önemli bir aşama daha kaydedilmiştir. Dahası, özellikle son
yıllarda oldukça çeşitli modelleri tasarlanan yeni nesil hava-uzay araçlarının
üretim ve test aşamalarında önemli başarılar elde edilmesi, çok yakın bir
gelecekte insan hayatında yeni bir imkân sahasının açılacağını göstermiştir.
Bu araçların uzay taşımacılığı, yörünge altı uzay turizmi, uluslararası havauzay taşımacılığı gibi misyonlarda kullanılması planlanmaktadır. Bu son
misyon kapsamında, uçuşun bir kısmında uzay yolunu da kullanacak bir
yörünge altı tip hava-uzay aracının yeryüzünün bir noktasından bir diğer
noktasına uçuşunu, bir ticarî hava aracına göre çok daha kısa (yaklaşık
sekizde birlik) bir sürede tamamlayacağı hesaplanmaktadır.
