Avrupa Birliği kurucu antlaşmalarında azınlık hakları ve çokkültürlülük yaklaşımları çerçevesinde incelenmesi

Abstract

Kendilerini kendi dil, din ve kültürlerine ve nesiller boyunca korunmuş bağımsız geleneklere sahip homojen varlıklar olarak tanımlayan azınlıkların, Avrupa Birliği (AB) kurucu antlaşmalarında, kurumlarının yasal çalışmalarında ve desteklenen proje ve platformlarında ve üye devletlerinin anayasal belgelerinde ve politikalarında tam manasıyla ortak bir tanımlamaya ulaşılmamış veya tanınma tam manasıyla olmamıştır. Çokkültürlü bir toplum perspektifi ve vizyonu yürüten AB, bu tanımlama ve tanıma sorununun üstesinden gelmek için birçok girişim sergilemektedir. Bu sebeple, birincil hukuk kaynakları olan ve bağlayıcı nitelik taşıyan kurucu antlaşmalardaki azınlıklarla ilgili hükümlerin varlığı ve etkinliği bir referans veya bir çıkış noktası olarak önem arz etmektedir. AB’nin azınlıklarla ilgili çalışmaları yasal bir paradoks oluşturmaktadır. Bu yasal paradoks, azınlıkların korunmasına yönelik araçların (başta antlaşmalar olmak üzere sözleşmeler, direktifler, tavsiyeler, raporlar, kararlar, izlemeler, vb.) sadece azınlıkların kültürünü ve kimliğini korumakla kalmayıp, aynı zamanda neyin korunmaya değer olduğunu tanımlamaya yardımcı olmasından kaynaklanmaktadır. Bu paradoksal izdüşümlerin açıklanmasında birçok görüş ve düşünce ileri sürülmüştür. Bu ileri sürülen düşüncelere ek olarak makale, farklı bir yaklaşım tarzı ve bakış açısı ortaya koyarak literatüre katkı sunmaya çalışmaktadır. Makalenin temel amacı, azınlık olgusunun tanımsal konfigürasyonlarını ortaya koyarak, AB’nin birincil mevzuatı olarak ifade edilen kurucu antlaşmaların içerisinde yer alan insan ve azınlık hakları ile ilgili hükümlerini çokkültürlülük yaklaşımları çerçevesinde değerlendirilmesinin ve incelenmesinin yapılmasıdır. Yine bu amaca yönelik makalede, içerik, betimleyici ve karşılaştırmalı analiz yöntemleri kullanılarak antlaşma hükümleri ile çokkültürlülük yaklaşımların varsayımları arasında belli ve açık bağlantılar kurulmaya ve oluşturulmaya çalışılmıştır.

Minority rights in the founding treaties of the European Union and its examination multiculturalism approaches

Abstract

Minorities who define themselves as homogeneous entities with their own language, religion and culture and independent traditions preserved for generations have not been fully defined or fully recognized in the founding treaties of the European Union (EU), in the legal work of its institutions and in their supported projects and platforms, and in the constitutional documents and policies of their member states. Pursuing the perspective and vision of a multicultural society, the EU is demonstrating many initiatives to overcome this problem of identification and recognition. For this reason, the existence and effectiveness of the provisions related to minorities in the constituent treaties, which are the primary sources of law and are binding, are important as a reference or a starting point. The EU's work on minorities constitutes a legal paradox. This legal paradox stems from the fact that the tools for the protection of minorities (conventions, directives, recommendations, reports, decisions, monitoring, etc., especially treaties) not only protect the culture and identity of minorities, but also help define what is worth preserving. Many views and ideas have been put forward in the explanation of these paradoxical projections. In addition to these ideas, the article tries to contribute to the literature by revealing a different approach and perspective. The main purpose of the article is to reveal the definitional configurations of the minority phenomenon and to evaluate and examine the provisions on human and minority rights in the founding treaties, which are expressed as the primary legislation of the EU, within the framework of multicultural approaches. Again, in this article, by using content, descriptive and comparative analysis methods, it is tried to establish and create clear connections between the provisions of the treaty and the assumptions of multicultural approaches.
