Digital Inheritance in Comparative Law

Abstract

The concept of "digital inheritance," which has emerged with the acceleration of digitalization, brings with it significant legal debates. This study addresses the definition of digital assets, whether they are included in the decedent's estate, and their inheritability from the perspective of Turkish law and comparative law. Within this scope, the legal status of social media accounts, contracts with service providers, the protection of personal data, and the balance between the deceased's privacy and the rights of heirs are examined. In light of German Federal Court and Turkish judicial decisions, it is argued that digital assets should pass to the heirs under the principle of universal succession. The study draws attention to the problems created by new digital assets proposing a new type of right called the "digital identity right" to encompass their complex nature, and concludes that a legal regulation on the subject is necessary.

Aim & Scope

AIM AND SCOPE

Comparative Law is an enigmatic, paradoxical and elusive subject in that, just as one thinks one has mastered it, another puzzle appears on the horizon. The puzzles start with the name of the subject, continue with its definition, aims, objectives, methodology and its use in practice, and culminate in its value and significance for legal science.

In the 21st Century, Comparative Law is blossoming as globalization ascends the interdependence between legal systems. As Bernhard Grossfeld expressed “A legal order that is not open to dealings beyond its own borders loses its connection to international development, and becomes rigid and sterile”. Hereupon, it must be enunciated that comparative law builds bridges between legal traditions and goes further than only comparing legally binding texts, legislation and cases. It is a dynamic, vital scientific field with transboundary roots investigating cultural, sociological, historical and even anthropological dimensions of legal systems.

If one perceives the world through the glasses of his own legal tradition, he may be falsified on the content and the context of notions belonging to foreign laws. Therefore, the Eurasian Journal of Comparative Law (EAJCL), which will be published by the Private Law Department members of Afyon Kocatepe Faculty of Law, aims to cultivate to the understanding of legal notions in different legal systems, create awareness of comparative law among legal scholars in European and Eurasian Region, neighbouring countries and especially in Turkey. EAJCL’s object involves demonstration of Comparative Law as not only a field of comparison of particular positive law concepts belonging to different foreign laws, but also it’s profound methodological background. At the crossroads of a diversity of legal traditions, EAJCL targets to increase legal interactions between the countries of the European and Eurasian Region and contribute to the development of comparative law theory. 

EAJCL is an open-access international, peer-reviewed journal that will be published twice a year. The language of publication is English. The journal accepts articles in the field of comparative law, especially on the legal systems of the European and Eurasian Region, specific legal problems of the European and Eurasian Region countries and the general theory of comparative law. EAJCL publishes original scientific studies through research articles, short reviews, case reviews, book reviews and translations. The conformity of the original papers subject to publication with the academic criteria is evaluated by two independent reviewers in a two-way blind review system.

EAJCL is an international, peer-reviewed journal that will be published twice a year. The language of publication is English. The journal accepts articles on comparative law, especially articles on the legal systems and specific legal problems of the European and Eurasian Region countries and the general theory of comparative law.

The journal aims to contribute to the development of comparative law.

Articles to be sent to the journal for publication will first be evaluated in terms of acceptability conditions. However, at the same time, the articles will be subject to serious editorial scrutiny. Articles submitted to the journal will be subject to an intihal.net query. Publications with a similarity rate of more than 20% will not be accepted.

The next stage is the referee evaluation phase, and EAJCL has adopted the double-blind referee system. 

When uploading your article to the system, you must also fill in and sign the copyright agreement and funding and conflict of interest declaration and upload it to the system. 

1. The written language of the journal is English. Articles must be sent with an English abstract of at least 100 and at most 150 words, with the article name and max. five keywords added to the beginning of the article.

2. Articles; It must be prepared in “Microsoft Word” program. Main text, 16x24 size, 3 cm margins from the top of the page, 2.5 cm margins from the bottom, right and left sides of the page, 10.5 point "Palatino Linotype" font, footnotes 9 point "Palatino Linotype" character, It should be written with a 5 mm indent in the spacing and paragraphs.

3. Articles; should not be more than 10.000 words, including footnotes but except abstract and bibliography, There is no character (word) limit for translated works.

4. The whole process of article acceptance will be carried out through the Dergipark manuscript System. Authors will upload their works that they want to be published in the journal through the Dergipark system.

5. The first page of the works to be sent must contain the following information about the author(s): Name-surname, title, institution, city/country, e-mail and ORCID ID information.

6. The titles of the submitted articles are appropriate to the text; It should be short and clearly expressed.

7. All references, tables and figures to be used in the works should be arranged using The Chicago Manual of Style. For more information about The Chicago Manual of Style, please visit https://www.chicagomanualofstyle.org/tools_citationguide/citation-guide-1.html

8. On the first line after the headings, paragraph indent is not used, the paragraph is started left-justified. Paragraph indent should be used for subsequent paragraphs.

9. Parts that are not directly related to the subject examined in the work, but require explanation or detailed information, should be added to the work using the footnote method.

10. At the end of the works, there must be a bibliography arranged alphabetically according to the Chicago reference system.

ETHICAL PRINCIPLES AND PUBLICATION POLICY

Plagiarism, falsification or misrepresentation of data, divisional publication, repetition of publication, inclusion of non-contributory authors, breach of copyrights and prevailing conflict of interest are unacceptable practices within the ethical rules.


The Eurasian Journal of Comparative Law applies the most advance principles regarding mistakes, ethical violations and disclaimers. It is deemed to be declared that the content of the studies submitted to the journal is original.


Necessary legal actions will be taken in case of any ethical violations regarding the above stated or similar principles. All parties involved in the publishing process (Editors, Reviewers, Authors and Publishers) are expected to agree on the following ethical principles.

GENERAL ACTIONS AGAINST SCIENTIFIC RESEARCH AND PUBLICATION ETHICS
Authorship: It is considered wrongful to include individuals who have not actively contributed to the work as authors or to exclude individuals who have contributed to the work from authorship. Authors should have contributed sufficiently to all stages of the work, such as planning, data collection and evaluation.


Falsification: Using data that is not based on research, does not exist in reality or has been altered is considered as data falsification.


Plagiarism: It is considered plagiarism to present the methods, original ideas, data, writings or figures of others as one's work in whole or in part without proper citation under scientific rules. In order to avoid plagiarism, authors should cite their works under scientific rules and pay attention to the citation of all scientific articles in their research.


Distortion: Changing the records or data collected without conducting research, showing devices or materials not used in the research as if they were used, falsifying or shaping the research results in line with the interests of the people and organizations receiving support are considered within the scope of distortion.


Dividing and Publishing: Inappropriate sectionalization of the results of research in a way that infringes the integrity of the research, publishing the sections in more than one number without referring to each other, and presenting these publications as separate publications are considered within the scope of the divisional publication.


Duplicate Publication: Presenting duplicate publications as separate publications without referring to previous publications is considered within the scope of publication repetition. The responsibility for the fact that the works submitted for evaluation have been previously published elsewhere or are in the evaluation process lies entirely with the authors. Authors should avoid repetition and take care in submitting original research.



RESPONSIBILITIES OF THE RELEVANT PARTIES
Editor's Responsibilities
1. The editor is responsible for publishing the submitted manuscripts. The editor evaluates submissions without taking into account the race, ethnicity, gender, religion, belief, nationality and political views of the authors. The decision is based on the article's significance, originality and clarity, as well as the validity of the work and its relevance to the scope of the journal. Applicable legal requirements regarding defamation, copyright infringement and plagiarism must also be considered.
2. Unpublished material used in a submitted article can only be used by the editor or editorial board members for their personal research purposes with the author's written permission.
3. The editor cannot share relevant information about the submitted manuscript with persons or institutions other than the corresponding author, reviewers, editorial board members and the publishing organization.

Responsibilities of Authors
1. Authors should indicate the originality of their work. Submitted articles must comply with the journal rules.
2. Authors should not have published the articles submitted to the journal elsewhere or submitted them for publication.
3. Authors should indicate the sources of the information in their studies and cite the studies in question.
4. Authors should guarantee that they have made a scientific contribution to the article, and it should be recognized that all authors have equal responsibility for the article.
5. If at any time authors notice a significant inaccuracy or uncertainty, they should immediately report the inaccuracy or uncertainty to the editor.

Responsibilities of Reviewers
5. If the reviewers do not consider themselves competent in the submitted article or if they consider that they cannot evaluate the article within the specified time, they should notify the editor and withdraw from the evaluation process.
6. The article submitted for evaluation should be considered as a confidential document.
7. Evaluations should be made impartially. No individual criticism of the author can be made. Reviewers should clearly state their views together with supporting arguments.
8. Reviewers should inform the editor about the similarity of the article with other publications.
9. Any data or considerations determined during the evaluation process of the submitted manuscript should not be used for personal advantage. Conflicts of interest should be reported to the editor.

Submitting articles to our journal, the review process, and publication are completely free of charge. No fees are charged for submitted articles or those accepted for publication. In accordance with our publication policy, we do not accept sponsorships or advertisements, and all expenses of the journal are covered by Afyon Kocatepe University.

Hukuk eğitimine Marmara Üniversitesi Hukuk Fakültesi'nde Başladı.  İstanbul'da bir süre avukatlık mesleğini icra ettikten sonra Kadir Has Üniversitesi'nde Yüksek Lisans ve İstanbul Ticaret Üniversitesi'nde Doktorasını tamamladı.  2017 yılında Afyon Kocatepe Üniversitesi'nde Ticaret Hukuku ABD'de Dr. Öğretim Üyesi olarak göreve başladı. Halen aynı kurumda görevine devam etmektedir.  Fikri ve Sınai Mülkiyet Hukukunda araştırmaları yoğunlaşmakadır. Arabulucu eğitmeni olarak görev üstlenmenin yanı sıra  faal Arabulucu olarak görev yapmaktadır. Marka ve Patent Vekilliği belgesine sahiptir.

Lisans öğrenimini 1994-1998 yılları arasında Anadolu Üniversitesi Hukuk Fakültesi’nde dönem birincisi olarak tamamlayan Mesut Aygün, 1998 yılının Eylül ayında, Anadolu Üniversitesi Hukuk Fakültesi Milletlerarası Özel Hukuk Anabilim Dalına araştırma görevlisi olarak atandı. 2002 yılında özel hukuk alanında yüksek lisans, 2008 yılında özel hukuk doktora derecesini elde etti. 2007-2008 yılları arasında doktora eğitim bursu ile çalışmalarını Sheffield/İngiltere’de sürdüren Mesut Aygün, 2008 yılında Anadolu Üniversitesi Hukuk Fakültesi Milletlerarası Özel Hukuk Anabilim Dalına yardımcı doçent olarak atandı. 2018 yılında Üniversitelerarası Kurul’dan Doçent unvanını elde eden Mesut Aygün, 2019 yılında Milletlerarası Özel Hukuk Anabilim Dalında doçent kadrosuna; 2023 yılında profesörlük kadrosuna atandı.

Milletlerarası Özel Hukuk Anabilim Dalı Başkanı, Özel Hukuk Bölüm Başkanı, Adalet Meslek Yüksek Okulu Müdürü gibi idari görevlerde bulunan Mesut Aygün, 2018-2021 yılları arasında Hukuk Fakültesi Senatörü olarak görev yaptı. 21 Kasım 2024 tarihinde Yükseköğretim Kurulu Yürütme Kurulu tarafından Anadolu Üniversitesi Hukuk Fakültesi Dekanı olarak asaleten atandı. Dekanlık ve Milletlerarası Özel Hukuk Anabilim Dalı Başkanı görevleri halen devam etmektedir. Yüksek lisans tezini “Türk Yabancılar Hukuku Açısından Yabancı Sigorta Şirketlerinin Türkiye`de Faaliyette Bulunması”, doktora tezini “Milletlerarası Özel Hukukta Kambiyo Senetleri”, doçentlik tezini “Milletlerarası Özel Hukukta Nafakaya İlişkin Yeni Sistem” ve Profesörlük takdim tezini de “Milletlerarası Usul Hukuku ile Kanunlar İhtilafı Hukuku Kuram ve Metodolojisi Çerçevesinde Yapay Zekâ” başlıklarıyla yayımlayan Mesut Aygün’ün, milletlerarası özel hukuk alanında makale, kitap, kitap bölümü, tebliğ gibi pek çok yayını bulunmaktadır. Federica De Robertis, lawyer, graduated from the University of Bologna, with a second degree in Spanish law from the University of Alcalà de Henares and was admitted to the Madrid Bar Association. She also holds a Master's degree in Derecho Comunitario y Derecho Mercantil de ‘Derecho de la competencia desleal, perspectivas del derecho español y comparado’ from the University of Alcalà de Henares (Madrid), and a Master's degree in Islamic Banking and Finance Law from the International Chamber of Commerce. A former contract professor of Comparative Commercial Law at the State University of Milan, he now lectures in Navigation Law at the Leonardo da Vinci Telematic University. He is a qualified mediator and regularly serves as curator and sales delegate for courts. He is editor of the legal journal P.Q.M., an expert in navigation and transport law, topics on which he has published in leading legal journals, and Visiting Professor of Navigation Law and European Union Law in several foreign universities.

1978 yılında Bursa Keles’te doğdu. İlkokul ve ortaokulu Bursa’da bitirdi. Lise eğitimini Bursa Erkek Lisesinde tamamladı. 2000 yılında Marmara Üniversitesi Hukuk Fakültesinden mezun oldu. 2001 yılında Dumlupınar Üniversitesi İktisadi ve İdari Bilimler Fakültesinde Araştırma Görevlisi olarak çalışmaya başladı. İstanbul Üniversitesi Sosyal Bilimler Enstitüsü Özel Hukuk Programından 2004 yılında yüksek lisans, 2012 yılında doktora eğitimini tamamladı. Yüksek lisans ve doktora eğitimini sürdürdüğü 2002 – 2012 yılları arasında İstanbul Üniversitesi Hukuk Fakültesi Ticaret Hukuku Anabilim Dalında araştırma görevlisi olarak çalıştı. Doktora eğitimi sırasında 2007-2009 yıllarında Köln Üniversitesi Hukuk Fakültesi ile Köln Üniversitesi Uluslararası Özel Hukuk ve Yabancılar Hukuku Enstitüsünde konuk bilim insanı olarak araştırmalarda bulundu. 2013 yılından buna yana İstanbul Üniversitesi İşletme Fakültesi Ticaret Hukuku Anabilim Dalında öğretim üyesi olarak görev yapmaktadır. Kambiyo Senetlerinde Sebepsiz Zenginleşme (2004) ve Cari Hesap Sözleşmesi (2012) şeklinde iki adet yayınlanmış monografik eseri vardır. Dr. sci. Ena Kazić-Cakar is an Associate Professor and Dean, at the Faculty of Law of International University of Sarajevo, in the scientific area of Criminal Law. She holds PhD in Law from the Faculty of Law of University of Sarajevo. Dr.sci. Kazic-Cakar received two Gold Medals as being the best student in her cohort during her BA and MA studies at the same University. She continued her professional training through the work in practice and through various types of seminars and international scientific conferences where she participated as a speaker. She has received several prestigious summer school scholarships for scientific development abroad. Her research currently addresses topics of sexual violence prevention and restorative justice. Professor Kazic-Cakar is an author of many scientific articles and books, including a book “Application of Educational Recommendations as a form of restorative justice in the Canton Sarajevo, for the period 2012-2017“, and „Sexual violence in the contemporary criminal law“, both published by the International University of Sarajevo. She is a reviewer for several renewed international law journals. She is a member of the Research Committee of the European Forum for Restorative Justice. She was a national expert for restorative justice from Bosnia and Herzegovina, within the project of “Methodology for Mapping - Criminal Justice Systems in CEE”, organized by the AFCRD.

Prof. Dr. András Osztovits is judge at the Hungarian Supreme Court (Kúria) and professor at the Károli Gáspár University in Budapest. Formerly he held different research and teaching positions in Heidelberg, Vienna, Dresden, Lisbon and Oxford. He has more than 180 publications in Hungarian, in English and in German. He is the editor of three Hungarian periodicals and edited the Handbook on the Treaty on European Union and the Treaty on the Functioning of the European Union. Koesrianti is a Professor of international law at the Faculty of Law, Universitas Airlangga (UNAIR) Surabaya Indonesia. She graduated from undergraduate law and has Sarjana Hukum (S.H) degree from Faculty of Law, UNAIR – Surabaya, Indonesia.(1981-1985). She hold LLM and PhD degrees from the Faculty of Law, University of New South Wales (UNSW) Sydney, Australia in 1997 and 2006 respectively as an awardee of Australian Development Scholarship (ADS) program. She teaches some subjects include international law, international business transactions, maritim law, international dispute resolution, international trade law, cyber law and ASEAN. Her research interests include international law, ASEAN, migration law, international dispute resolution, SME, cyber law and international business transaction. She has attended and presented papers in several international conferences, and has published several articles on international law topics, including ASEAN, international dispute settlements, international commercial contract, and migrant workers as well as SME. She was the Director of Airlangga Institutes for Internasional Law Studies/AIILS (2018 – 2020) and currently she is the Head of International Law Department, Faculty of Law – Universitas Airlangga.

Aygun is Lecturer in Law at the Institute of International Shipping and Trade Law at Swansea Law School. She joined the Institute in August 2022 after completing her PhD and LLM studies at Southampton Law School. Her PhD was on "Enhancing Party Autonomy under the Hague Convention on Choice of Court Agreements 2005: Comparative Analysis with the 1958 New York Arbitration Convention and 2012 Brussels Recast Regulation". Before becoming a member of the IISTL, she worked as a lecturer at Bournemouth Law School, taught different courses at Southampton University, also lectured at the Law School of Baku State University. She also worked as the Managing Editor of the Global Constitutionalism journal published by the Cambridge University Press from 2019 to 2023. She has been awarded several Max Planck research grants and Konrad Zweigert scholarships, held various visiting fellowships at different institutions in Europe. She is a qualified lawyer in the Azerbaijan Republic and prior to her Ph.D. studies at the University of Southampton, she worked as a lawyer at the Ministry of Education of the Azerbaijan Republic. Her primary research focuses on international business, trade, and maritime law, commercial conflict of laws and private international law, intellectual property law, commercial dispute resolution, as well as digitalisation and legal innovation. Her publications have appeared in different venues such as Wolters Kluwer, Kluwer Arbitration, Sweet and Maxwell, Routledge, Informa Law, etc. She has recently been invited to UNIDROIT as a visiting scholar for conducting her research on Digital Assets and Private law.

Andrea Borroni is a tenured Associate Professor of Private Comparative Law at the “Luigi Vanvitelli” University of Campania, at the “Jean Monnet” Department of Political Sciences, and qualified Full professor in the same academic field.
He has been visiting professor in many Universities in Italy and abroad and he is now full professor of law (Private law) at the New Vision University in Tbilisi.
He is regular visiting professor at Royal University for Women in Bahrein and he was among the professors at the 2019 Unesco Summer Academy, Istanbul, on the “Women empowerment”.
After graduating in law at the University of Pavia (summa cum laude), he gained an LL.M. in Comparative Law, with all the honors, in the 2006, at the Louisiana State University and obtained a Doctorate in Comparative law in the 2006 from the University of Trento and, a second degree (summa cum laude) in Banking law and anti-usury regulation.
He was awarded of the Van Calker Scholarship from the Swiss Institute of Comparative Law of Lausanne (2004), of the Rotary Foundation Ambassadorial Scholarship in the U.S.A. (2005-2006), of the Paul Hebert LSU Law Center Fellowship (2005-2006) and of the American Society of Comparative Law scholarship (2017).

Prof. Mohammed Zaheeruddin has received a Gold Medal for scoring the highest marks in LLM program and received his Ph.D. from Osmania University, India. Before his joining in the UAE University, he worked as a Principal at the Post Graduate College of Law, Osmania University, India. He has passed General Course on "Intellectual Property" from WIPO Academy, Geneva. His publications include Two Books: ‘A Handbook for Judicial Service Examinations’ and ‘A Handbook for Prosecutors and District Judges Examinations’. He has published twenty-eight research papers, including four in Scopus Indexed Journals.
He has twenty-eight Years of teaching experience out of which sixteen years at the UAE University. He has received two Diploma Certificates from the University of Copenhagen, Denmark. As a coach participated in Philip C. Jessup International Law Moot Court competition, USA in 2010 &2012, and the ICC Moot Court Competition, the Hague, Netherlands in 2014. He has been coaching UAEU students' team participating in the Willem C. Vis International Commercial Arbitration Moot, Vienna, Austria, from 2010 to till date.
