Avrupa Birliği (AB) üyesi ülkeler, belli alanlarda sahip oldukları yetkilerini Birliğe devrederek AB’ye üye ülkelerde doğrudan uygulanan hukuk kuralları yaratma yetkisini verirler. Ancak sağlık hizmetlerine ilişkin düzenlemeler bu kapsamda yer almayıp yerellik ilkesi benimsenmiştir. Diğer yandan aday ülkeler mevzuat uyumu açısından izlenmekte ve tespit edilen hususlar yıllık ilerleme raporları ile kamuoyuna açıklanmaktadır. İlerleme raporları sayesinde ülkeler eksikliklerini görerek uyum kapsamında atılacak adımları planlayabilmektedir. Bu çalışmada, T.C. Sağlık Bakanlığı tarafından Avrupa Birliği mevzuat uyumu kapsamında yürütülen çalışmalar, uyum çalışması yapılamayan ya da yeterli ilerleme sağlanamayan alanlar ortaya konulmuştur. Ayrıca Avrupa Birliği’ne tam üyelik yolunda sağlığın yer aldığı alanlarda karşılaşılan sorunlar, Türkiye İlerleme Raporları çerçevesinde irdelenerek tespit edilen sorunlara yönelik çözüm önerileri ortaya konmaya çalışılmıştır.
European Union (EU) member states delegate their powers in certain areas to the Union, to establish rules of law directly applicable in member states. However, regulations regarding health services were not included in this scope and the principle of subsidiarity was adopted. On the other hand, candidate countries are monitored in terms of compliance with the legislation and the issues identified are announced to the public through country reports annually. Thanks to the progress reports, countries can see their shortcomings and plan the steps to be taken within the scope of harmonization. In this study, the studies carried out by the Ministry of Health of the Republic of Turkey within the scope of harmonization with the European Union legislation, the areas where harmonization could not be made or sufficient progress could not be achieved were revealed. In addition, the problems encountered in the field of health on the way to full membership to the European Union were examined within the framework of the Turkey Progress Reports and suggestions were tried to be brought to the identified problems.
