Abstract

Uluslararası Adalet Divanı’nın Somali ile Kenya arasındaki davada verdiği 12 Ekim 2021 tarihli kararında, sınırlandırma hukuku açısından üç husus öne çıkmıştır. İlki, sınırlandırmanın temel amacı olarak hakça bir çözüm gereğini vurgulamasıdır. İkincisi, esas noktaların seçiminde belirli noktaları göz ardı etmesidir. Üçüncüsü ise, üç aşama yöntemini esas alırken bir ilgili şart olarak kesme etkisine ilişkin yaptığı değerlendirmelerdir. Bu bağlamda Divan, kesme etkisine maruz kalacak sahilin içbükeyliğini tespit ederken daha geniş bir coğrafi uzanımı esas almıştır. Bu uygulama, uluslararası yargı içtihadıyla uyumlu olmakla beraber kesme etkisinin tespitinde belirleyici olacak şekilde sınırlandırmanın tarafı olmayan Tanzanya’nın sahillerinin içbükeyliğin tespitinde dikkate alınması, itirazlara konu olmuştur. Söz konusu kararın Türkiye açısından önemi, hem Doğu Akdeniz sınırlandırma uyuşmazlığına yönelik tezler açısından hem de Afrika’daki balıkçılık ilişkileri açısından ortaya çıkmaktadır.

Maritime Area Delimitation in the Indian Ocean: Some Observations on the Somalia–Kenya Judgment of the International Court of Justice

Abstract

In the 12 October 2021 dated judgment of the International Court of Justice on the case between Somalia and Kenya, three issues came to the fore in terms of delimitation law. The first one is the judgment emphasizes the need for an equitable solution as the main purpose of delimitation. The second is that it ignores certain points in the selection of base points. The third point is about the evaluation made on the cut-off effect as a relevant circumstance while taking the threestage method as a basis. In this context, while determining the concavity of the coast that will be exposed to the cut-off effect, the Court has taken a wider geographical configuration as a basis. Although this practice is in line with the jurisprudence of the international judiciary, it has been the subject of objections that the coasts of Tanzania, which is not a party to delimitation, are taken into account in the determination of the concavity. The importance of the judgment for Turkey emerges both in terms of theses on the Eastern Mediterranean delimitation dispute and in terms of fisheries relations in Africa.
