Abstract

Kapsam ve sınırları farklılık arz etse de hemen hemen tüm hukuk sistemlerinde evlenme engellerine rastlanır. İslam aile hukukunda da nispeten geniş bir içeriğe sahip olan evlenme engelleri söz konusudur. Klasik fıkıh geleneğinde bu engeller daimi ve geçici evlenme engelleri olarak iki kategoride incelenir. Çerçevesinin nass tarafından çizilmiş olması hasebiyle her iki tür evlenme engeli üzerinde- ayrıntı da kısmî farklılıklar olsa da- temelde fukahanın ortak bir tutumu söz konusudur. Bu iki tür evlenme engelinin dışında zina, zinaya sebep olabilecek fiiller ve halvetin evlenme engeli olup olmadığı meselesi fukahayı bir hayli meşgul etmiş, oldukça tartışmalı bir konudur. Bu makale, işte bu üç durumun evlenme engeli meydana getirip getirmeyeceği konusunu incelemek üzere kaleme alınmıştır

Hurmah al-Musaharah and Some Related Issues

Abstract

Almost in the all legal systems, with the scope and boundaries difference, have barriers for the marriage. In the Islamic family law also, has a relatively wide range of barriers for marriage. In the classical fiqh tradition, this barrier is examined in two categories as permanent and temporary marriage barriers. Due to the fact that the frame is drawn by nass, there is a common attitude of fuqaha, although there are partial differences in detail- on both types of marriage disability. Apart from these two kinds of marriage barriers, adultery, acts that could lead to zina, and the halva is the controversial issue whether they are will be marriage barriers or not among the fuqha. This article disputes the question of whether these three situations will prevent marriage
