Environmental Rights in The Context of The Right to Solidarity and Its Contribution to The Climate Combating

Abstract

The role of collective and will-based actions for a sustainable world is clear. When the desire to create a more livable world is accepted as a right, this can only happen with a change in perspective. One of the important tools through which the reflections of this change are seen is the environmental phenomenon. Questions in the context of the environmental phenomenon and environmental problems are dialectical and directly affected by the will and motivations of the actors. Therefore, the role of the actors results in the environment having a rights content.
This study addresses the prioritization of the right to environment. Therefore, by accepting the right to environment and the supremacy of environmental law in which it is included, the subject is addressed within this scope by emphasizing the increasing role of this right in combating climate change, which is one of the main environmental problems. Considering the increasing effects of climate change, while the necessity of environmental localization in the combat is pointed out, the importance of environmental governance is emphasized on the other hand, and the importance of accepting the right to the environment as an indispensable component in this combat is discussed.

Dayanışma Hakkı Bağlamında Çevre Hakkı ve İklim Mücadelesine Katkısı

Abstract

Sürdürülebilir bir dünyanın tesis edilmesinde kolektif ve istence dayalı eylemlerin rolü belirgindir. Daha yaşanabilir yeni bir dünya yaratmayı isteme bir hak olarak kabul edildiğinde uzun vadeli değişikliklerin üretilmesi ancak bakış açısının değişimi ile mümkün olmaktadır. Bakış açısındaki değişimin doğrudan ve dolaylı yansımalarının görüldüğü önemli araçlardan biri de daha yaşanabilir bir dünyanın yaratılmasında çokça tartışılan çevre olgusudur. Çevre olgusu ve çevre sorunsalı bağlamındaki sorgulamalar diyalektik olup aktörlerin istenci ve motivasyonundan doğrudan etkilenmektedir. Dolayısıyla aktörlerin başat rolü çevrenin bir hak içeriğinin olması sonucunu doğurmaktadır.
Bu kapsamda çalışmada çevrenin karşılaştığı baskılara karşın etkili yöntemlerden biri olarak insanların temel ve evrensel haklarından biri olan çevre hakkının öncelenmesi ele alınmıştır. Dolayısıyla çevre hakkı ve dahil olduğu çevre hukukunun üstünlüğü veri kabul edilerek, günümüzde başlıca çevre sorunlarından biri olan iklim değişikliği mücadelesinde bu hakkın artan rolüne vurgu yapılarak konu bu kapsamda ele alınmaktadır. Artan iklim değişikliği etkileri göz önünde bulundurulduğunda; bu etkilerle mücadelede, bir yandan çevresel yerelleşmenin gerekliliğine işaret edilirken, diğer yandan çevresel yönetişimin önemine vurgu yapılmakta, bu mücadelede çevre hakkının esaslı bir bileşen olarak kabul edilmesinin önemi tartışılmaktadır.
