Problems Encountered in the Functioning ana Implementation of Proposals of Confidence in the Second Constitutional Period

Abstract

Due to the fact taht the Kanun-ı Esasi was not fully structured according to the parliamentary system, the parliamentary system was in complete in many aspects during the First Constitutional Period. However, with the changes made in the Kanun-ı Esasi in 1909, the parliamentary system was given a very democratic structure. The most important change in terms of parliamentary control is taht the government has been made accountable to the parliament. However, due to some legal deficiencies and in experience, problems have been experienced in the function in gand application of control mechanisms. For example, neither in the constitutionnor in the by laws of the 1877 Members of Parliament and Ayan Assemblies, there is norulepertaining to a parliamentary question. For this reason, in the Second Constitutional Period, the parliamentary questions caused various debate sand in this period, the parliamentary questions were processed according to the conventions.

The no-confidence question took place both in the constitution and in the Mebusan Bylaws. However, the fact taht the ministers were not responsible to the assembly rendered the interrogationdys functional. In 1909, important changes were made in the constitution in terms of no-confidence ana the members of the government were made responsible to the Parliament.

In the article, the functioning of the no-confidence motion ana the problems encountered are explained especially based on the Memorandum of Understanding of the Majlis-i Mebusan. In addition, the pres ana research works of the period were alsoused.

İkinci Meşrutiyet Dönemi’nde Gensoru Önergelerinin İşleyişi ve Uygulamasında Karşılaşılan Sorunlar

Öz

Kânun-ı Esasi’nin tam olarak parlamenter sisteme göre yapılandırılmamış olmasından dolayı, I. Meşrutiyet Dönemi’nde parlamenter sistem pek çok yönden eksik kalmıştır. 1909 yılına gelindiğinde ise Kânun-ı Esasi’de yapılan değişikliklerle, parlamenter sistem oldukça demokratik bir yapıya kavuşturulmuştur. Parlamenter denetim açısından en önemli değişiklik ise hükûmetin meclise karşı sorumlu hale getirilmiş olmasıdır. Ancak bazı hukuki eksiklikler ve tecrübesizlikler nedeniyle denetim mekanizmalarının işleyiş ve uygulamasında sorunlar yaşanmıştır. Örneğin ne anayasada ne de 1877 Mebusan ve Ayan Meclisleri iç tüzüklerinde, soru önergesine ait bir kural bulunmamaktadır. Bu nedenle II. Meşrutiyet Dönemi’nde soru önergeleri çeşitli tartışmalara neden olmuş ve bu dönemde soru önergeleri teamüllere göre işlemiştir.
Gensoru, hem anayasada ve hem de Mebusan İç tüzüğünde yer almıştır. Ancak nazırların meclise karşı sorumlu olmaması gensoruyu işlevsiz hale getirmiştir. 1909 yılında, gensoru açısından Kanun-ı Esasi’de önemli değişiklikler yapılmış ve hükûmet üyeleri Mebusan Meclisi’ne karşı sorumlu hâle getirilmiştir. Hatta Türk parlamento tarihinde ilk defa bir sadrazam güvensizlik oyu ile iktidardan düşürülmüştür.
Makalede gensoru önergesinin işleyişi ve karşılaşılan sorunlar özellikle Meclis-i Mebusan Zabıt Ceridesi’ne dayalı olarak incelenmiştir.
