A Criminal Investigation in Mecca after the Tanzimat: The Case of Abdullah Agha from Divriği
Abstract
This study examines a criminal case from Mecca in the second half of the nineteenth century to reveal how criminal proceedings functioned in the Ottoman provinces after the Tanzimat reforms. The case, which centers on the murder of Abdullah Agha of Divriği during his pilgrimage, offers a significant example of how judicial procedures in the provinces were shaped by the legal and administrative transformations introduced during the Tanzimat era. Based on official documents and detailed interrogation records preserved in the Ottoman Archives, the analysis provides concrete data on the provincial implementation of the 1858 Penal Code. The stages of the suspect’s escape, the interrogation of his relatives, his eventual capture, and his questioning before local councils in Mecca offer valuable insights into the functioning of provincial judicial mechanisms and their interaction with local administrative structures. The subsequent involvement of the Meclis-i Vâlâ and its judicial branch, the Muhakemat Dairesi, in delivering the final verdict illustrates the central authority’s supervisory role over provincial legal processes. Thus, this study contributes to Ottoman legal history by presenting a case that reflects the institutional transformation of the legal system in the provinces during the Tanzimat period.

Mekke’de Tanzimat Sonrası Bir Ceza Soruşturması: Divriğili Abdullah Ağa Olayı
Abstract
Bu çalışma, Tanzimat sonrası Osmanlı taşrasında ceza yargılamalarının işleyişini ortaya koymak amacıyla XIX. yüzyılın ikinci yarısında Mekke’de gerçekleşen bir cinayet vakasını incelemektedir. Hac ibadeti sırasında Mekke’de öldürülen Divriğili Abdullah Ağa’nın ölümüyle sonuçlanan olay, Osmanlı taşrasında yürütülen adli süreçlerin Tanzimat reformları sonrasında nasıl şekillendiğini göstermesi açısından önemli bir örnek teşkil etmektedir. Osmanlı Arşivi’nden elde edilen resmî belgeler ve ayrıntılı sorgu tutanaklarına dayanarak yürütülen çalışma, 1858 tarihli Kanunname-i Ceza’nın taşradaki uygulamalarına dair somut veriler sunmaktadır. Zanlının firarı, yakınlarının sorgulanması, ardından yakalanarak Mekke’de yerel meclis tarafından yeniden sorgulanmasına dair süreçler; adli mekanizmaların işleyişine ve yerel idari yapıların yargılama sürecine etkisine dair önemli ipuçları içermektedir. Çalışmada, yerel meclisin yürüttüğü soruşturma ve davalardan sonra İstanbul’daki Meclis-i Vâlâ Muhâkemât Dairesi’nin devreye girerek nihai hükmü vermesi, merkezi idarenin taşradaki yargı süreçlerini denetlemesi gibi detaylar gözlemlenebilmektedir. Bu bağlamda çalışma, Tanzimat’la birlikte Osmanlı hukuk sisteminde yaşanan kurumsal dönüşümün taşra pratiğindeki bir yansımasını inceleyerek, hukuk tarihine örnek vaka incelemesiyle katkı sunmayı hedeflemektedir.
