TRADITIONAL SPECIALITIES GUARANTEED IN TERMS OF INDUSTRIAL PROPERTY CODE

Abstract

    TSG right bears a resemblance to the geographical indication right. For instance, a name registered as a traditional speciality guaranteed may be used by any operator marketing a product that conforms to the corresponding specification. However, differently from geographical indications, TSGs do not designate to the geographical origin of the product.

     Traditional Specialities Guaranteed right has not been accepted as an industrial property right under Turkish law. On the other hand, Industrial Property Code regulated this type of right as well and expressed that many of the articles regarding the industrial property rights shall be applicable for TSGs.

     The concept of Traditional Specialities Guaranteed (TSG) has entered into Turkish law in 2017, by Industrial Property Code, no. 6769. A name shall be eligible for registration as a TSG where it describes a specific product or foodstuff that results from a mode of production, processing or composition corresponding to traditional practice for that product or foodstuff. In order to be qualified as a TSG, the name must have been used traditionally at least for thirty years to describe the relevant product in the related market.
