Çocuk Haklarının Uygulanma Mekanizmaları: Gelişmiş ve Gelişmekte Olan Ülkelerde Karşılaştırmalı Sistematik Derleme

Abstract

Bu araştırmanın amacı, gelişmiş ve gelişmekte olan ülkelerde çocuk haklarının uygulanma mekanizmalarını sistematik ve karşılaştırmalı biçimde incelemektir. Çalışma, çocuk haklarının hayata geçirilmesinde karşılaşılan engelleri, başarılı uygulama örneklerini ve bağlamsal faktörleri bütüncül biçimde ele alarak literatürdeki önemli bir boşluğu doldurmayı hedeflemektedir. Çalışma, PRISMA yönergeleri izlenerek yürütülen sistematik derleme yöntemiyle gerçekleştirilmiştir. 2020–2025 yılları arasında yayımlanan, hakların uygulanmasına yönelik mekanizmaları, engelleri ve bağlamsal dinamikleri ele alan 35 İngilizce akademik çalışma incelenmiştir. Kodlama sürecinde tematik analiz yaklaşımı benimsenmiş, veriler “engeller”, “uygulamalar” ve “bağlam” başlıkları altında sınıflandırılmıştır. Bulgular, çocuk haklarının uygulanmasında yasal boşluklar, kaynak yetersizlikleri, kurumsal koordinasyon eksiklikleri ve kültürel normların önemli engeller oluşturduğunu ortaya koymuştur. Bununla birlikte, bazı ülkelerde bağlama duyarlı politika tasarımları, yerel katılım mekanizmaları ve disiplinler arası iş birliği modelleri, hakların daha etkin biçimde korunmasına katkı sağlamaktadır. Bağlamsal çatışmaların doğru analiz edilmesi, bu başarıların sürdürülebilirliği açısından kritik görülmektedir. Etkili çocuk hakları uygulamaları, yasal düzenlemeler ile yerel koşullar arasında uyum gerektirir. Politika yapıcıların, uygulamaların tasarımında ve değerlendirilmesinde bağlamsal faktörleri dikkate almaları önerilmektedir.

Implementation Mechanisms of Child Rights: A Comparative Systematic Review of Developed and Developing Countries

Abstract

The aim of this study is to systematically and comparatively examine the mechanisms for implementing children’s rights in developed and developing countries. By addressing the barriers, successful implementation examples, and contextual factors in the realization of children’s rights in a holistic manner, the study seeks to fill an important gap in the literature. The research was conducted using the systematic review method, following PRISMA guidelines. A total of 35 English-language academic studies published between 2020 and 2025, focusing on implementation mechanisms, barriers, and contextual dynamics, were reviewed. A thematic analysis approach was adopted during the coding process, and the data were classified under the themes of “barriers,” “practices,” and “context.” The findings revealed that legal gaps, resource constraints, lack of institutional coordination, and cultural norms constitute significant obstacles to the realization of children’s rights. However, in some countries, context-sensitive policy designs, local participation mechanisms, and interdisciplinary cooperation models contribute to more effective protection of rights. Accurate analysis of contextual conflicts is considered critical for the sustainability of these successes. Effective implementation of children’s rights requires alignment between legal frameworks and local conditions. It is recommended that policymakers take contextual factors into account in the design and evaluation of practices.
