The Question of the Applicability of the Provisions of the Successive Offence in the Offence of Misuse of Public Duty in the Light of the Court of Cassation Practice YCGK, 2018/445 E., 2021/12 K., 28.01.2021

Abstract

The main purpose of the criminal procedure is to reveal the truth. The investigation phase, which begins as soon as the public prosecutor is informed of a fact that causes an impression that a crime may have been been committed, either through a report of crime or any other way, is of serious importance in terms of revealing the truth, since it includes the process of collecting evidence. The Code of Criminal Procedure no. 5271 contains provisions that put the focus on public prosecutors during the investigation phase. It is of great importance for the public prosecutors, to fulfi ll their duties diligently in order for the criminal proceedings can run as smoothly as possible. In this study, it has been discussed whether the aforementioned omission acts of a public prosecutor, who acts negligently in the form of not taking action in a reasonable time in a serious part of the fi les that should be investigated in accordance with his duty, can be considered within the scope of misuse of public duty regulated in Article 257 of the Turkish Penal Code No. 5237. In addition, if it is accepted that the aforementioned crime has occurred, whether the negligent acts in question can be considered within the scope of a successive off ences has been included in the study as another matter of discussion.

YARGITAY UYGULAMASI IŞIĞINDA GÖREVİ İHMAL SUÇUNDA ZİNCİRLEME SUÇ HÜKÜMLERİNİN UYGULANABİLİRLİĞİ SORUNU (YCGK, 2018/445 E., 2021/12 K., 28.01.2021)

Abstract

Ceza muhakemesi sürecinin temel amacı, maddi gerçeği ortaya çıkarmaktır. Suç şüphesinin yetkili makamlara intikali ile başlayan soruşturma evresi, delillerin toplanması sürecini kapsamında barındırdığından maddi gerçeğin ortaya çıkarılması hususu açısından ciddi önem arz etmektedir. 5271 sayılı Ceza Muhakemesi Kanunu, soruşturma evresinde Cumhuriyet savcılarını ön plana alacak şekilde hükümler barındırmaktadır. Cumhuriyet savcılarının ceza muhakemesi sürecinin mümkün olduğunca sağlıklı ilerlemesi açısından görevlerini özenle yerine getirmeleri ciddi önem arz etmektedir. Bu çalışmada; kendisine görevi gereğince tevdi edilen soruşturma dosyalarının ciddi bir kısmında makul sürede işlem yapmamak şeklinde ihmali davranışlar gerçekleştiren bir Cumhuriyet savcısının bahsi geçen ihmali davranışlarının 5237 sayılı Türk Ceza Kanunu’nun 257’nci maddesinde düzenlenen görevi kötüye kullanma suçu kapsamında değerlendirilip değerlendirilemeyeceği hususu tartışılmıştır. Buna ek olarak bahsi geçen suçun oluştuğunun kabulü halinde, söz konusu ihmali davranışların zincirleme suç kapsamında değerlendirilip değerlendirilemeyeceği hususu bir diğer tartışma hususu olarak çalışmada yer almıştır.
