I. Journal Publication Ethics
Journal of Case Law Analysis (JCLA) adheres to a publication policy that is committed to national and international academic principles and ethical values. In this context, the standards set forth by the Council of Higher Education in the "Scientific Research and Publication Ethics Directive" and by Ankara Hacı Bayram Veli University in the "Ankara Hacı Bayram Veli University Publication Directive," as well as the internationally recognized standards established by
COPE (Committee on Publication Ethics),
Directory of Open Access Journals (DOAJ) and
Open Access Scholarly Publishers Association (OASPA) and constitute the fundamental elements of JCLA's publication policy. Other national or international directives or standards concerning publication ethics are considered valid by JCLA, provided they do not conflict with those mentioned above.
Articles that are objectively determined to violate the relevant principles and/or standards before, during, or after the publication evaluation process at JCLA will be rejected. If such a determination is made for a work already published in JCLA, the relevant work will be retracted.
II. Responsibilities of the Editorial Board
Editors and associate editors serving on the JCLA board must perform their duties objectively, impartially, and free from all forms of prejudice.
Editors and associate editors serving on the JCLA board are obligated to act with the level of confidentiality required by their duties.
Editors and associate editors serving on the JCLA board shall cooperate fully in all matters and procedures related to JCLA. The essence of this cooperation is the fair distribution of duties within JCLA.
III. Responsibilities of Authors
Authors who wish to have their works published in JCLA are obligated to comply with the provisions of the Law on Intellectual and Artistic Works No. 5846, the aforementioned national and international principles and standards, and other principles and standards adopted by JCLA.
Only finalized judicial decisions may be reviewed in JCLA. Authors are deemed to have warranted that the judicial decision they have submitted for review meets this criterion.
Authors are deemed to have warranted that the articles they submit for publication to JCLA have been prepared in accordance with the relevant provisions, principles, and standards.
IV. Responsibilities of Reviewers
Reviewers shall diligently and promptly review articles sent to them by JCLA or its authorized units diligently and promptly; they shall evaluate the articles impartially and fairly, in accordance with their field of expertise.
Should reviewers identify any violation of academic principles, ethical values, or national or international principles or standards in the articles they are evaluating, they are obligated to inform the Journal's Editorial Board immediately.
V. Conflicts of Interest
JCLA guarantees the independent and impartial completion of the publication process by taking into account potential conflicts of interest among the author(s), reviewers, and editors.
JOURNAL OF CASE LAW ANALYSIS PUBLICATION POLICY
JCLA is a "Peer-Reviewed Journal" published twice a year, in June and December.
Finalized judicial decisions may be reviewed in JCLA. The author is deemed to have warranted that the decision submitted to JCLA meets this criterion.
As JCLA is a peer-reviewed journal, only articles that have successfully passed the peer-review process are published.
Ankara Hacı Bayram Veli University Faculty of Law is committed to the highest standards of publication ethics. In addition to national standards and its own ethical principles, JCLA adopts the ethical publishing principles published by the
Committee on Publication Ethics (COPE),
Directory of Open Access Journals (DOAJ) and
Open Access Scholarly Publishers Association (OASPA).
Articles to be published in JCLA may be written in Turkish, English, German, or French. It is recommended that case note submissions to JCLA be prepared in accordance with the following structure and order: the facts of the case, legal issues, decisions of the relevant authorities, and evaluation.
Articles are submitted via DergiPark.
Articles submitted for publication in JCLA must be original, not previously published elsewhere, and not under consideration for publication elsewhere. The submission of an article by the author constitutes the author's warranty in this regard.
Articles must conform to JCLA's submission guidelines. In cases where a rule is not found in the specified citation method detailed in the guidelines, the
OSCOLA (The Oxford University Standard for Citation of Legal Authorities) system should be followed.
Authors are considered to have accepted that their articles, as submitted to the journal, are ready for publication. Each article is evaluated by one editor and at least two reviewers. Articles found by the editors that do not meet scientific criteria or JCLA’s submission guidelines or contain excessive typographical errors will be rejected. This preliminary review also includes screening with plagiarism detection software.
Reviewers are selected by the editor. One of the selected reviewers will be an academic from Ankara Hacı Bayram Veli University Faculty of Law, and the second will be from outside the institution, chosen according to the keywords of the article. Confidentiality is essential throughout the review process, and reviewers may only share the article with the editor's permission.
Articles are peer-reviewed under a double-blind system. In accordance with the double-blind system, articles that pass the editorial board’s preliminary evaluation are sent to two reviewers with the authors’ names removed. Authors are not informed about which reviewers have been assigned to their article.
In the event of conflicting reports from the reviewers (one positive, one negative), a third reviewer is appointed and their evaluation is sought. If both reviewers' reports are negative, a third review is not conducted. Articles not published as a result of the peer review are not returned to the author, and the author is informed of the decision.
If revisions are requested in a reviewer's report, the author may only make changes within the scope of the revisions specified in the report. After the author has made the corrections suggested by the reviewers, the article may be sent for re-review upon the reviewers' recommendation.
The views expressed in the works published in JCLA and the responsibility for these views belong solely to the author.
All articles not complying with with ethical standards, including those containing potential irregularities identified after publication in JCLA, will be retracted.
All publication rights for works accepted for publication in JCLA, including the right to publish the full text in electronic format, are held by Ankara Hacı Bayram Veli University for use in all media (print, visual, audio, digital, etc.) both domestically and internationally. Authors are deemed to have transferred their copyrights to the University, and no royalties will be paid to the authors.
