Bosna Hersek Devletinin Yönetsel Yapısı

Abstract

Tarihsel olarak, Bosna-Hersek'te üç büyük etnik grup bulunmaktadır. Bunlar: Boşnaklar (Müslümanlar), Hırvatlar (Katolik Hıristiyanlar) ve Sırplar (Ortodoks Hıristiyanlar)’dır. Bölgede bu üç etnik grup arasındaki gerilim hiç sona ermemiş ve oldukça kanlı savaşlara neden olmuştur. Gerilimin sona ermesi için uluslararası baskılar sonucu üç etnik grup arasında Dayton Barış Anlaşması imzalanmıştır. Dayton Barış Anlaşmasıyla; mevcut anayasal düzen, oldukça parçalanmış, güçlü etnik güç paylaşımı hükümlerine sahip “karmaşık federalist” bir sistem haline gelmiştir. Oluşturulan bu sistemle Bosna Hersek içerisinde; Bosna Hersek Federasyonu, Sırp Cumhuriyeti ve Brčko özerk bölgesi yer almaktadır. Bosna Hersek’te ki karmaşık etnik yapı sebebiyle çözüm olarak görülen yeni yönetsel yapı yönetsel sorunları da beraberinde getirmektedir. Çünkü oluşturulan bu yönetsel yapı parçalı ve karmaşık iktidar yapısıdır. Çalışmanın temel amacı Bosna Hersek’te, Dayton Barış Anlaşması öncesi sürece de yer vererek, oluşturulan yeni yönetsel yapı hakkında bilgi vermek ve bu anlaşmanın yönetsel yapı üzerindeki etkileri üzerine bir değerlendirme yapmaktır. Bu değerlendirme neticesinde Bosna Hersek’te siyasi makamların sayısının aşırılığı ve yönetsel yapıya önemli müdahalelerde bulunabilecek Yüksek Temsilciler Ofisinin varlığının yönetsel yapıda büyük bir sorun teşkil ettiği sonucuna varılmıştır. Ayrıca, halkın üzerinde anlaşarak kabul ettiği bir Anayasa’ya sahip olmamaları sorun çözmekten ziyade sorun yaratan bir yönetsel yapı ortaya çıkarmıştır.

Admınıstratıve Structure of the State of Bosnia and Herzegovina

Abstract

Historically, there have been three major ethnic groups in Bosnia and Herzegovina. These are Bosnians (Muslims), Croats (Catholic Christians), and Serbs (Orthodox Christians). The tension between these three ethnic groups in the region never ended and caused quite bloody wars. As a result of international pressure to end the tension, the Dayton Peace Agreement was signed between the three ethnic groups. With the Dayton Peace Agreement; The current constitutional order has become a highly fragmented "complex federalist" system with strong ethnic power-sharing provisions. With the system created in Bosnia and Herzegovina, the Federation of Bosnia and Herzegovina, Republika Srpska, and Brčko autonomous region formed. The new administrative structure, which is seen as a solution due to the complex ethnic structure in Bosnia and Herzegovina, also brings administrative problems because of administrative structure is a fragmented and complex power structure. The study's primary purpose is to give information about the new administrative structure created in Bosnia and Herzegovina, including the process before the Dayton Peace Agreement, and to assess the effects of this agreement on the administrative structure. As a result of this evaluation, it was concluded that the excessive number of political authorities in Bosnia and Herzegovina and the existence of the Office of High Representatives, which can make significant interventions in the administrative structure, constitute a significant problem in the administrative structure. In addition, the fact that they do not have a Constitution that is accepted by the people by consensus has created an administrative structure that creates problems rather than solving problems.
