Assessments on The Criteria of Public Legal Personality

Abstract

Public legal persons are established by constitution, law or Presidential Decree (=by constitutive acts). These organizations also have certain competence and prerogatives. An organization can be established explicitly as a public legal person by the Constitution or aforementioned constitutive acts. In this case, this organization is a public legal person. These organizations are subject to public procedures and categorized organically within the body of administration. Their actions and transactions subject to private law do not change their nature of public legal personality. There are also organizations which are not determined as public legal persons perform public services. They can be seen as private-law legal persons in terms of their form of organization and activities although they are public legal persons in respect of their establishment features. However, they can be seen as public legal persons in terms of their prerogatives and competence associated with administrative duties which they undertake. Organizations which undertake administrative duties by the means of permission or administrative contract are private-law legal persons with regards to their establishment, organization and activities related to public services that they perform. Furthermore, their nature of private-law legal personality does not change in their relationship with third parties to whom they provide public services. On the other hand, their activities related to the public services and based on prerogatives of public power can exceptionally be understood as a sui generis administrative function.
