Abstract

Dünya Sağlık Örgütü bünyesinde kabul edilen Tütün Kontrolü Çerçeve Sözleşmesi sonrasında başta Avustralya olmak üzere, birçok ülke tarafından tütün ürünlerinin düz paketlenmesine yönelik düzenlemeler kabul edilmiştir. Düz paket düzenlemeleri ile tüm tütün mamullerinin ilgili otorite tarafından belirlenecek standart bir renkte paketlenmesi zorunlu kılınmaktadır. Ayrıca, paket üzerinde marka ve ürün adının ilgili otorite tarafından belirlenecek belli bir yazı tipi stili ve boyutunda yer alması dışında logolarının, marka tasvirlerinin, renklerin ve tanıtım metinlerinin tütün ürünleri ve perakende paketleri üzerine konulması yasaklanmaktadır. Tütün firmalarınca uygulamanın başta fikri mülkiyet hakları olmak üzere ulusal ve uluslararası düzeyde ticaret ve yatırım kurallarını ihlal ettiği ileri sürülmüş ve düz paket uygulamasına geçen ülkelere karşı dava süreçleri başlatılmıştır. Söz konusu davaların önemli bir kısmı tamamlanmış olmakla birlikte, halen süren davalar da bulunmaktadır. Bu davalar ile ileride açılması muhtemel davaların sonuçları, düz paket uygulamasının dünya çapında geleceğini belirleyecektir.
