Abstract
İş Sağlığı ve Güvenliği Kanunu, işveren ile çalışanların hak ve yüküm- lülüklerini düzenlemektedir. Bu yapısı, işyerlerinde ortaya çıkan iş kazaları ve meslek hastalıklarında sorumlunun belirlenmesine yardımcı olmaktadır. Aynı yasa, sorumlunun belirlenmesi sonrasında, onun kusur düzeyinin tespit edile- bilmesini de sağlamaktadır. Bu çalışmada, 6331 sayılı yasada düzenlenen yasal yükümlüklerden, uygulamada en sık sorumluluk sebebi olanlar üzerinde durul- maktadır.
