Avrupa Birliği’nde Medyada Çoğulculuğun Korunması ve Teşvik Edilmesine İlişkin Yasa ve Girişimler

Abstract

Medya özgürlüğü ve medyada çoğulculuk, Avrupa demokrasinin yapı taşlarındandır. Yapılan araştırmalar, AB üyesi ülkelerin tamamında medya özgürlüğü ve medyada çoğulculuğa yönelik gerek siyasi gerekse ekonomik ciddi tehditlerin varlığını ortaya koymaktadır. Bu alanda doğrudan yasama yetkisinin olmaması, AB’yi bu tehditlerle bir kısım bağlayıcı hukuki araçlarla birlikte ağırlıklı olarak bağlayıcı olmayan araçlar kullanarak mücadele etmeye zorlamaktadır. Ancak sorunların teşhisi, “isimlendirme” ve “utandırma”’nın ötesine geçerek tehditlerin ortadan kaldırılması için yeterli olmamaktadır. Bu çalışmada, medyada çoğulculuk konusunda AB’nin elinde olan hukuki araçlar, güçlü ve zayıf yönleriyle analiz edilecektir.

A Critical Analysis of the Existing Rules and Initiatives Fostering Media Pluralism in the European Union

Abstract

Media freedom and media pluralism are among the pillars of European Democracy. Research in this area has revealed the existence of serious political and economic threats to media freedom and media pluralism in all EU member states. The lack of a direct legislative power in this area forces the EU to combat these threats by using mainly soft-law instruments along with a few hard-law instruments. However, the identification of the problem is not sufficient to eliminate threats by going beyond "naming" and "shaming". In this study, the legal instruments of the EU on media pluralism will be analyzed with their strengths and weaknesses.
