Abstract

Bankruptcy postponement is regulated by Articles 376-

377 of Turkish Commercial Code and 179 of Execution and

Bankruptcy Code. It is a legal remedying process developed to

recover “insolvent” capital stock companies from bankruptcy by

correcting their financial situation under trustee management,

should court finds the proposed “improvement plan” convincing.

This study aims to profile the postponement litigations filed in Turkey

between 2009-2013. During that period, 2.712 litigations were

filed, 1.921 of them were concluded. Litigations were concluded

in 285 days on average where postponement was accepted for

30% while refused for 48%.

İflasın Ertelenmesi ve Türkiye’de 2009-2013 Arasındaki İflasın Ertelenmesi Davalarının Analizi

Abstract

İflasın ertelenmesi, Türk Ticaret Kanunu’nun 376-377. maddeleri

ile İcra ve İflas Kanunu’nun 179. maddesinde düzenlenmiştir.

Erteleme; “borca batık” sermaye şirketinin sunacağı “iyileştirme

projesi”nin mahkemece inandırıcı bulunması durumunda, kayyım

yönetiminde, şirketin finansal durumunun düzeltilerek iflastan

kurtarılması için geliştirilmiş bir yasal çözüm sürecidir. Bu çalışma,

2009-2013 döneminde Türkiye’de açılan iflasın ertelenmesi davalarının

profilinin belirlenmesini amaçlamaktadır. Bu dönemde

2.712 dava açılmış ve bunların 1.921’i sonuçlanmıştır. Davalar

ortalama 285 günde sonuçlanmış, % 30’unda erteleme kabul edilmiş,

% 48’inde reddedilmiştir.
