Abstract

Kira öder gibi uzun vadeli ev satın alma sistemi olarak bilinen ipotekli konut finans sistemi mortgage, gayrimenkul edinmede kullanılan finansman yöntemlerinden bir tanesidir. Mortgage sürecinde üçüncü taraf, yasal borçlanıcı ve finansal kurumlar dışında mortgage sürecine dahil olan ve sürece yön veren diğer katılımcılardır. Günümüzde mortgage borçlanmalarından doğan hileler özellikle uygulamanın yaygınlaştığı ABD’de gittikçe artmaktadır. Bunun nedeni ise bu tür hilelerin nispeten daha kolay yapılabilmesi, son derece kazançlı oluşu ve mortgage sözleşmelerinde üçüncü taraflarca yapılan hilelerin ortaya çıkarılmasının son derece güç oluşudur. Şüpheli durumların tespitinde kullanılan kırmızı bayraklar (red flags) yöntemi son derece etkin ve verimli bir yöntem olup hile olma ihtimalini gösteren hile uyarıcılarıdır. Mortgage borçlanma sürecinde üçüncü taraflarca yapılan hilelerin önlenmesinde ve ortaya çıkarılmasında kırmızı bayraklar yöntemi üstüne gidilip araştırılacak ve dikkat edilecek noktaların tespitinde sinyaller vermektedir.

Abstract

(The Frauds Made By Third Person On The Mortgage Contracts And The Red Flags To Reveal These Frauds) Mortgage which is considered as buying home in long term like paying rent is one of the financing ways used in buying a real estate. The third people in the process of mortgage are legal borrowers and the other participants joining the process and leading it except of financial institutions. Recently frauds arising from mortgage contracts are increasing more and more especially in USA. The reasons of this are the capability of these frauds to be done easily, being more profitable and the difficulty of revealing these frauds which are made by third people. The method of red flags used in defining suspicious circumstances is very efficient and effective that they are the fraud stimulatory which show fraud possibility. Red flag method which is on revealing and preventing the frauds in the process of mortgage borrowing made by third people gives signals on defining points that will be inquired and focused on .
