Bağımsız Çalışanlar İçin İşsizlik Sigortası

Abstract

Sosyal güvenliğin temel amacı mesleki, fizyolojik veya sosyo-ekonomik nitelikteki sosyal riskler karşısında sigortalıyı korumaktır. Sigortalının karşılaştığı sosyo-ekonomik risklerden birisi ise işsizliktir. İşsizlik riskine karşı getirilen işsizlik sigortası çalışma arzusu, yeteneği ve iradesine sahip olan işçinin, işini kendi isteği ve kusuru dışında kaybetmesiyle uğradığı gelir kaybının kısmen de olsa geçici bir süre için telafisini amaçlamaktadır. Ancak, bağımsız çalışanların da işçiler gibi işsizlik riskiyle karşı karşıya kaldığı bir gerçektir. Özellikle COVID-19 salgını, bağımsız çalışanlara ekonomik ve sosyal yönden derinlemesine tesir etmiş; bağımsız çalışanlar da işçiler gibi iş ve gelir kayıpları yaşamıştır. Keza küreselleşme, teknolojik gelişmeler, ekonomik krizler, ülkelerdeki demografik değişim ve son zamanlarda hızlıca artan iklim değişiklikleri, çalışma hayatını önemli ölçüde değiştirmekte ve bu değişimden bağımsız çalışanlar da etkilenmektedir. Böylece işsizlik riskiyle mücadele, ülkeler tarafından acilen ele alınması gereken zorluklardan biri olarak görülmeye başlanmış; işsizlik sigortasının bağımsız çalışanlara yönelik genişletilmesi gerekliliği yönündeki görüşler artmıştır.
Türk sosyal güvenlik hukuku incelendiğinde, bağımsız çalışanları işsizlik riskine karşı korumayı amaçlayan çeşitli yasal düzenlemeler mevcuttur. Bu düzenlemelerin başında, 2017 yılında 4447 sayılı İşsizlik Kanunu’na bir tür işsizlik sigortası olarak eklenen “Esnaf Ahilik Sandığı sigortası” gelmektedir. Getirilen düzenlemenin en önemli özelliği sigortalılık halinin, ilgili sigorta kapsamına giren sigortalılar açısından zorunlu tutulmasıdır. Keza, 4447 sayılı İşsizlik Kanunu’nda belirlenen nedenlerle işsiz kalan Esnaf Ahilik Sandığı sigortalısına ödenek ödenmekte; çeşitli hizmetler Türkiye İş Kurumu tarafından sağlanmaktadır. Ancak bağımsız çalışanlar için kabul edilen Esnaf Ahilik Sandığı sigortası çeşitli yönleriyle doktrinde eleştirilmektedir.
İlgili bu çalışmada öncelikle bağımsız çalışan kavramı incelenecektir. Akabinde, uluslararası hukukta bağımsız çalışanlar için işsizlik sigortası uygulamaları üzerinde durulacaktır. Son olarak Türk sosyal güvenlik hukukunda bağımsız çalışanlar için kabul edilen Esnaf Ahilik Sandığı sigortası analiz edilecek ve söz konusu sigorta kolunun aksayan yönlerine işaret edilecektir.

Unemployment Insurance for Self-employed Persons

Abstract

The main purpose of social insurance is to protect the insured against social risks of an occupational, physiological, or socio-economic ground. One of the socio-economic risks faced by the insured is unemployment. Unemployment insurance, which is brought against the risk of unemployment, primarily aims to compensate, atleast temporarily, the income loss suffered by the employee who has the desire, ability and will to work, when s/he loses her/his job without her/his own will and neglect. However, it is a fact that self-employed persons, like employees, also face the risk of unemployment. In particular, the COVID-19 pandemic has severely affected them economically and socially and they have experienced job and income losses. Likewise, globalization, technological developments, economic crises, demographic change in countries and recently rapidly increasing climate changes are significantly changing working life and self-employed persons are also affected by this change. Combating the risk of unemployment that has emerged due to the pandemic has begun to be seen as one of the challenges that States need to address urgently; the need to expand unemployment insurance to self-employed persons has begun to be discussed.
When Turkish social security law is examined, there are various regulations that aim to protect self-employed persons against the risk of unemployment. The most important of these regulations is the “Insurance of Tradesman Akhism Fund”, which was added to the Unemployment Law No. 4447 in 2017 as a type of unemployment insurance. The most central feature of the regulation introduced is that the insurance status is made mandatory for the insured who are covered by the relevant insurance. Likewise, various services are provided by the Turkish Employment Agency to the insured who become unemployed due to the reasons specified in the Unemployment Law No. 4447. However, the Insurance of Tradesmen Akhism Fund accepted for self-employed persons is criticized in the doctrine in various aspects.
In this relevant study, the concept of self-employed persons will be examined first. Then, unemployment insurance practices for them in international law will be emphasized. Finally, the Insurance of Tradesmen Akhism Fund, which is accepted for them in Turkish social security law, will be analyzed and the deficiencies of the related insurance will be pointed out.
