The Problem of E-Commerce Taxation

Abstract

Electronic commerce (e-commerce), took part in our lives with technological advancements. It holds a significant place in the daily lives especially thanks to widespread use of internet. However, it can be seen that there are some deficiencies and problems with taxation of e-commerce, based on modern laws. Among the most significant ones of these issues are determination of the liability, concept of workplace, definition of the act that is subject to tax, and the characteristics of the profit. Such issues are not as simple that a given market can solve. Thus, global measures has to be taken and common path should be followed. Also, it causes serious income losses due to the tax base determination problems. This study assess those issues under the perspective of OECD and EU too.

E-Ticaretin Vergilendirilme Sorunsalı

Abstract

Elektronik ticaret (e-ticaret), yaşanan teknolojik gelişmelerle beraber hayatımıza girmiştir. Özellikle internetin yaygınlaşmasıyla beraber e-ticaret günlük hayatta oldukça önemli bir yer edinmiştir. Fakat, e-ticaretin vergilendirilmesiyle ilgili günümüz kanunlarına bakıldığında bir takım problemlerin veya eksikliklerin olduğu görülmektedir. Bunlar özellikle mükellefiyetin belirlenmesi, işyeri kavramı, vergiyi doğuran olayın tespiti ve elde edilen kazancın niteliği gibi konulardır. Bu gibi konular, piyasanın kendi içinde tek başına çözüme kavuşturabileceği kadar basit değildir. Bu sebeple küresel anlamda adımlar atılarak, ortak bir yol izlenmelidir. Ayrıca temelde, matrah tespiti problemlere yol açarak devletler açısından ciddi bir gelir kaybına neden olmaktadır. Bu çalışmada e-ticaret sorunu, OECD ve AB’nin de bakış açısıyla birlikte ele alınıp, değerlendirilecektir.
