İngiliz Kamu Personel Yönetimine Genel Bir Bakış: Kamu Hizmetlerine Giriş, Performans Değerlendirme ve Disipline İlişkin Düzenlemeler

Abstract

Türkiye’de kamuoyuna açıklanan Kamu Personel Rejimi Kanun Tasarısı esneklik, liberalleşme, sözleşmeli istihdam, performansa bağlı değerlendirme ve ücretlendirme gibi ilkeleriyle henüz uygulamaya geçmeden tartışılır hale gelmiştir. Kamu Personel Rejimi Kanun Tasarısı pek çok açıdan bu çalışmanın konusunu oluşturan İngiliz Kamu Personel Yönetimi’ndeki uygulamalara benzer öneriler getirmektedir. “Açık yarışma", "liyakat", "eşitlik", "yansızlık" gibi geçmişin mirasından alıkonulan unsurlara rağmen yaşanan reform süreci ile birlikte İngiltere’de tekçi ve merkezi hiyerarşik nitelikteki Whitehall ve Westminster yapılarının yerini esnek kamu örgütlenmesi almıştır. Bu bağlamda reform sonrası İngiliz kamu personel yönetiminin kamu hizmetlerine giriş, performans değerlendirme ve disipline ilişkin düzenlemeleri çalışmanın konusunu oluşturmaktadır. Söz konusu analizin, esnek kamu yönetiminin “kuralsızlık” ve “keyfiyet” anlamına gelmediğinin anlaşılması noktasında faydalı olacağı düşünülmektedir

AN OVERVIEW OF THE BRITISH PUBLIC PERSONNEL MANAGEMENT: THE ARRANGEMENTS FOR RECRUITMENT, PERFORMANCE EVALUATION AND DISCIPLINE

Abstract

Public Personnel Regime Draft Law announced to the public in Turkey has already become controversial for its principles such as flexibility, liberalization, employment-on-contract, performance based assessment and pricing even without having been in practice. Public Personnel Regime Draft Law puts forward recommendations similar to the applications English Public Personnel Management that constitutes the subject matter of this study in many aspects. With the reform that is experienced in spite of the factors that are withhold from the legacy of the past such as “open competition”, “merit”, “equality", “impartiality”, Whitehall and Westminster structures in England which are monists and with a central hierarchical character has been replaced by the flexible public organization. Within this context, regulations of post-reform English public personnel management on introduction to public services, performance, assessment and discipline constitute to subject matter of the study. It is considered that the said analysis is beneficial for understanding that flexible public management does not mean "lawlessness" or "arbitrariness".
