Akrabalar Arası Taşınmaz Satışının Edinilmiş Mallara Katılma Rejiminin Tasfiyesine Etkisi
Abstract
Bir kişi paylı mülkiyet şeklinde hak sahipliğinin bulunduğu taşınmazdaki payını, üçüncü bir kişiye satabilir. Böyle bir durumda diğer paydaşların satışa konu edilmiş olan payı aynı şartlarla satın almasını sağlayan hak, yasal önalım hakkı olarak tanımlanmaktadır. Kural olarak, yasal önalım hakkı üçüncü kişilere yapılan pay satışında kullanılacak olsa da bu kuralın bazı istisnaları vardır. Bu istisnalardan birisi de taşınmazdaki payın akrabalar arası satışa konu olmasıdır.
İstisna niteliğindeki bu işlemde devreden kişi payı, bağışlama veya payın miras paylaşımına girmesini engellemek amacıyla devretmektedir. Her iki durumda da taraflar satış sözleşmesi yapma iradesine sahip olmadığından, bu işlemler muvazaalı işlemlerdir. İşte istisna niteliğindeki bu pay satış işleminde devralan, yasal önalım hakkını kullanılmasını engellemek için, kendi muvazaalı işlemine dayanmaktadır. Devralanın bu savunması yasal önalım hakkının kullanılmasını engelliyor olsa da söz konusu savunmanın edinilmiş mallara katılma rejiminin tasfiyesi bakımından birtakım sonuçları doğmaktadır. Sözü edilen sonuçlar eşin, payın devredeni veya devralanı olmasına göre farklılık arz etmektedir. Bu bağlamda çalışmamızda, ilk önce yasal önalım hakkı ve muvazaa kavramı genel olarak açıklanmaktadır. Akabinde akrabalar arası satış sözleşmeleri genel olarak izah edilmektedir. Ardından edinilmiş mallara katılma rejiminin tasfiyesi genel hatlarıyla açıklanmaktadır. Son olarak ise akrabalar arası satışın edinilmiş mallara katılma rejiminin tasfiyesi açısından sonuçları değerlendirilmektedir.

The Effect of the Sale of Immovable Property Between Related Parties on the Liquidation of the Regime of Participation in Acquired Property
Abstract
A co-owner in a property held under co-ownership may transfer or sell his or her share to a third party. In such a case, the right that allows the other co-owners to purchase the share subject to the sale under the same conditions is defined as the statutory right of pre-emption. As a rule, although the legal preemptive right is exercised in the sale of shares to third parties, this rule has certain exceptions. One of these exceptions is the case where the share in the immovable property is made the subject of a sale between related parties.
In this exceptional case, the share is transferred either as a gift or to exclude it from the inheritance distribution. In both situations, since the parties do not possess a genuine intention to conclude a contract of sale, these transactions constitute simulated transactions. In this exceptional type of share transfer, the transferee relies on his or her own simulated transaction in order to prevent the exercise of the statutory right of pre-emption. Although this defence prevents the exercise of the statutory right of pre-emption, it gives rise to certain consequences with regard to the liquidation of the matrimonial property regime of participation in acquired property. These consequences vary depending on whether the spouse is the transferor or the transferee of the share. In this context, the present study first explains the statutory right of pre-emption and the concept of simulation in general terms. Subsequently, the general framework of the liquidation of the matrimonial property regime of participation in acquired property is outlined. It then discusses contracts of sale concluded between relatives. Finally, the consequences of sales between relatives in terms of the liquidation of the regime of participation in acquired property are evaluated.
