IMMIGRANT SMUGGLING AND INTERVENTION POWERS OF COAST GUARD FROM TURKISH TERRITORIAL WATERS TO THE HIGH SEA

Abstract

Conflict and instability in certain parts of the world such as the Black Sea, the Mediterranean, Africa and South East Asia in recent years have exacerbated the phenomenon of irregular migration by sea. Human trafficking at sea also consti-tutes one of the fastest growing transnational organized crime. The Republic of Turkey, which is surrounded by seas on three sides, has to deal with the migrant crisis due to its geographical location. Turkey maintains its own coast guard under the Coast Guard Command. When it comes to migrant smuggling, it is an important issue for Turkey to reveal what legal intervention rights it has in the face of this smuggling. In this study, the legal rights of the coast guard arising from law of the sea in intervening a Turkish-flagged or foreign-flagged ship flee-ing to the high seas from the territorial waters were examined.

Denizlerde Göçmen Kaçakçılığı ve Türk Karasularından Açık Denizlere Sahil Güvenliğin Müdahale Yetkileri

Abstract

Son yıllarda Karadeniz, Akdeniz, Afrika ve Güney Doğu Asya gibi dünyanın belirli bölgelerinde mevcut olan çatışma ve istikrarsızlık, deniz yoluyla düzensiz göç olgusunu şiddetlendirmiştir. Deniz yoluyla insan kaçakçılığı aynı zamanda en hızlı büyüyen ulusötesi organize suçlardan birini oluşturmaktadır. Üç tarafı denizlerle çevrili olan Türkiye Cumhuriyeti’nin coğrafi olarak bulunduğu konumdan ötürü göçmen krizi ile ilgilenmek durumundadır. Türkiye kendi sahil güvenliğini Sahil Güvenlik Komutanlığı nezdinde korumaktadır. Türkiye’nin göçmen kaçakçılığı söz konusu olduğunda bu kaçakçılık karşısında hangi hukuksal müdahale haklarının var olduğunu ortaya koyması önemli bir meseledir. Çalışmada karasularından hareketle açık denizlere kaçan Türk bayraklı bir gemiye müdahale edilmesinde sahil güvenliğin deniz hukukundan kaynaklı temaül haline gelen hukuksal hakları bu çalışmada incelenmiştir.
