AB YAPAY ZEKÂ YASASI UYARINCA DEPLOYER KAVRAMI: YASAMA SÜRECİNDEKİ SEYRİ, GETİRDİKLERİ VE TÜRKÇE KARŞILIĞI SORUNU

Abstract

YZ Yasası’nın hem Türkiye’deki YZ operatörlerine doğrudan uygulanabilirliği hem de olası ulusal düzenlemeye model alınabilirliği nedeniyle Türkçeye aktarılması ve Türkçede anlaşılması önemlidir. Bununla birlikte YZ Yasası’nın düzenlediği aktörlerden birini tanımlamak üzere tercih ettiği deployer kavramının Türkçe karşılığı konusunda belirsizlik mevcuttur. Çalışma, kavramın Türkçede farklılaşan kullanımlarını değerlendirerek, en azından YZ Yasası’nın Türkçe çevirisi ve olası ulusal düzenleme bağlamında uygun karşılığın belirlenmesine katkıda bulunmayı amaçlamaktadır. Bu doğrultuda çalışmada öncelikle kavramın AB yasama sürecindeki seyrine ve tercih edilme nedenine odaklanılmakta, YZ Yasası uyarınca deployer olarak nitelendirilmenin koşulları ve bu nitelendirmenin getirdikleri açıklanmakta, kavramın AB resmî dillerindeki karşılıkları gösterilmekte ve buradan hareketle bazı saptamalarda bulunulmaktadır. Bunu takiben Türkçedeki belirli kullanımların neden yerinde olmadığı tartışılmakta ve benimsenebilecek karşılıklar önerilmekte ve gerekçelendirilmektedir. Her halükârda, bu konuda olası ulusal düzenlemede tercih edilecek deyimin yasa koyucunun takdirinde olduğunun ve bu tercihin kaçınılmaz olarak hukuk öğretisi ve uygulamasındaki kullanımı da şekillendireceğinin farkında olarak, kanıta dayalı bir tercih yapılması gerektiği vurgulanmaktadır.

THE CONCEPT OF “DEPLOYER” UNDER THE EU’S AI ACT: EVOLUTION IN THE LEGISLATIVE PROCESS, IMPLICATIONS, AND THE PROBLEM OF ITS TURKISH EQUIVALENT

Abstract

The AI Act is important to be translated into Turkish and understood in Turkish, both because of its direct applicability to AI operators in Turkey and because it can be taken as a model for a potential regulation in Turkey. However, there is uncertainty about the Turkish equivalent of the concept of ‘deployer’, which is preferred by the AI Act to define one of the actors it regulates. This paper, by evaluating the different terms used in Turkish to cover ‘deployer’, aims to contribute to the determination of the appropriate equivalent, at least in the context of the Turkish translation of the AI Act and potential domestic regulation. In line with this aim, the paper focuses on the course of the concept in the EU’s legislative process and the reason for its preference. It explains the conditions for qualifying as a ‘deployer’ under the AI Act and the implications of this qualification. It demonstrates the equivalents of the concept in the official languages of the EU and makes some conclusions based on this. The paper, later, discusses why certain Turkish terms are not appropriate. It recommends possible equivalents and justifies them. In any case, it emphasises that an evidence-based choice should be made, being aware that the choice of the term to be preferred in a potential domestic regulation on this subject is at the discretion of the legislator and that such choice will inevitably shape the use in legal doctrine and practice.
