Penal Execution Regime For Individuals Sentenced Or Detained For Terrorism-Related Offenses In Türkiye
Abstract
Prisons, which are acknowledged to occupy a significant place within the stages of radicalization, host distinct practices within penal execution regime for individuals sentenced or detained for terrorism-related offences, as compared to ordinary crimes. Certain presuppositions concerning terrorism offences, together with a presumption of dangerousness, give rise to differentiated applications within the penal execution regime. Accommodation conditions, rehabilitative activities, and communication with the outside world constitute major areas where such differentiation becomes evident. Beyond these aspects, it is observed that the divergence becomes even more pronounced at critical thresholds where the execution of the sentence is relaxed and release becomes possible. Conditional release and its derivative measure, probation, are implemented with particular caution in the execution of sentences for terrorism offences. A stricter penal execution regime is applied. Sensitive to societal reactions, the execution regime becomes even more attentive to public sentiment when terrorism offences are concerned. This study examines the execution regime applicable to terrorism offences in light of legislation, practice, and judicial decisions.
