Öz

The procedure and conditions for accession to the European Union are regulated by the basic legal texts of the Union as well as the various legal documents of its institutions. Those procedure and conditions have been applied to Turkey’s accession since the declaration of its candidacy at the Helsinki Summit of 1999 as was the case for other candidate countries. This study deals with the basic principles, conditions and procedures of the current enlargement process which also includes Turkey and the implications thereof on the outcome of the accession negotiations. In that context, the main focus will be on the phrase that “long transitional periods, derogations, specific arrangements or permanent safeguard clauses, i.e. clauses which are permanently available as a basis for safeguard measures” as stipulated in the Negotiation Framework for Turkey and whether such measures could be considered as feasible, applicable or fair on the basis of the fundamental principles of the EU legal order.

AB Hukukunun Temel İlkeleri Çerçevesinde AB’ye Katılım ve Türkiye’nin Müzakere Çerçeve Belgesinde Yer Alan Esaslar

Öz

Avrupa Birliği’ne katılımın usulü ve koşulları Avrupa Birliği’nin temel metinlerinde ve AB kurumlarının çeşitli belgelerinde düzenlenmektedir. Söz konusu usul ve koşullar diğer aday ülkeler gibi Türkiye’ye de 1999 yılında Helsinki Zirvesi’nde adaylık statüsünün kabulünden itibaren uygulanmaya başlanmıştır. Türkiye’nin de dahil olduğu son genişleme evresi ya da dalgası bakımından uygulanan temel esaslar, özellikle katılım müzakerelerinin tabi olduğu koşullar ile bunların Türkiye’nin katılım müzakerelerinin oluşturmaktadır. Bu çerçevede özellikle üzerinde durulacak konu ise katılım müzakerelerinin yürütülme esaslarının düzenlendiği Türkiye için Müzakere Çerçeve Belgesinde yer alan “uzun geçiş dönemleri, özel düzenlemeler, derogasyonlar ve daimi korunma önlemlerine başvuru imkanı” gibi hususların AB hukukunun temel ilke ve esasları çerçevesinde ne ölçüde mümkün, adil ve uygulanabilir olduğudur
