AVRUPA PARLAMENTOSU’NUN VE KONSEYİ’NİN DİJİTAL TEK PAZARDA TELİF HAKLARINA VE BAĞLANTILI HAKLARA İLİŞKİN 2019/790 SAYILI DİREKTİFİ HAKKINDA BAZI DEĞERLENDİRMELER

Öz

Avrupa Komisyonu tarafından kabul edilen Dijital Tek Pazar Stratejisi’nin amaçlarından biri Avrupa Birliği’ne üye ülkelerin telif hakları mevzuatını yeknesaklaştırmaktır. Bu amacı gerçekleştirebilmek adına ilk defa 2016 yılında Dijital Tek Pazarda Telif Haklarına İlişkin Direktif önerisi hazırlanmıştır. Bireylerin ifade hürriyetinin kısıtlanması başta olmak üzere çeşitli açılardan yoğun eleştirilere uğrayan Direktif önerisi, yoğun tartışmalara rağmen Avrupa Konseyi’nde 15.4.2019’da kabul edilerek nihaî halini almıştır. Söz konusu Direktif, telif haklarına ilişkin Avrupa Birliği mevzuatında köklü değişikliklere yol açmıştır. Çalışmamızda bu değişiklikler değerlendirilmeye çalışılacaktır.

Some Assessments About the Directive 2019/790 of the European Parliament and of the Council on Copyright and Related Rights in the Digital Single Market

Abstract

One of the aims of the Digital Single Market Strategy adopted by the European Commission is to unify the copyright legislation of the member states of the European Union. In order to realize this aim, a Proposal named the Directive on the Copyright in the Digital Single Market was prepared for the first time in 2016. The Proposal, which was subjected to serious criticism in various respects, in particular the restriction of the freedom of expression of individuals, was adopted by the Council of Europe on 15.4.2019 despite the intense debate. This Directive has led to drastic changes in the legislation of the European Union about copyrights. In this study, these changes will be tried to be evaluated.
