LİZBON ANTLAŞMASI SONRASI GÜÇLENDİRİLMİŞ İŞBİRLİĞİ MEKANİZMASI İLE İLGİLİ HUKUKİ MESELELER

Öz

Güçlendirilmiş işbirliği, daha fazla bütünleşme amacı taşıyan üye devletlere bu
imkânı sunan bir mekanizmadır. En önemli özelliklerinden birisi de bu işbirliğinin
Antlaşmalara uygun olarak ve AB’nin mevcut hukuk düzeni içerisinde kurulmasına
olanak tanımasıdır. Güçlendirilmiş işbirliği mekanizması Lizbon Antlaşması ile
birlikte fonksiyonel hale getirilmiş ve işbirlikleri kurulmaya başlamıştır. Kullanım
alanlarının artması ve Brexit süreci/bütünleşme tartışmaları, bu mekanizmanın
gelecekte daha sık olarak uygulanma ihtimalini ortaya çıkarmaktadır. Bu nedenle
güçlendirilmiş işbirliği mekanizmasının hukuken doğru anlaşılması ve sağlam
temellere oturtulması gerekmektedir. Bu bakımdan mekanizmanın derinlemesine/çok
yönlü olarak incelenmesinde fayda bulunmaktadır. Bu makalede, güçlendirilmiş
işbirliğinin gelişim süreci incelenmiş, hangi ilke ve usullere bağlı olarak kurulması
gerektiği ortaya konmuş ve sonrasında uygulama ve ortaya çıkan hukuki eksiklikler
bu çerçevede değerlendirilmiştir.

Enhanced Cooperation Mechanism After the Treaty of Lisbon

Öz

Enhanced cooperation is a mechanism which gives member states the
opportunity to integrate further. One of its most important characteristics is that it allows the establishment of the cooperation in accordance with the Treaties and
within the existing EU legal system. Increase in the areas of usage and Brexit
process/integration debates introduced the possibility of frequent implementation of
enhanced cooperation in the future. This is why enhanced cooperation must be
understood correctly and must be built on solid legal basis. This importance requires
an in-depth analysis of this mechanism. This article examines the development of
enhanced cooperation, the principles and procedures for the establishment of the
mechanism and evaluates implementation and legal deficiencies within this
framework.
