Right to silence is one of the most important rights of the suspect as well as the defendant. The evolution and modern use of this important criminal justice concept has led debates in not only the Inquisitorial (Civil Law/Continental Europe) but also the Adversarial (Common Law/Anglo-Saxon & Anglo-American) systems. However the real irony lies in the new fact that the creator of the right to silence is now the one who wants to abolish the very essence of this concept, i.e. United Kingdom. Another shocking development is that the Supreme Court of the United States changing his opinion about the invoking of this constitutional right in its latest decisions. This analysis aims at researching the Turkish theoretical and practical understanding of the right to silence from the perspective of international conventions, English and American legislations as well as court decisions. The acts of UK & USA prove that even the most libertarian states, have the tendency of limiting the human rights & liberties at the disadvantage of the individual at the slightest opportunity caught during the exercising of their criminal jurisdiction within their geographical borders whereby proving us that the Leviathan must at all times be hold under control

Susma hakkı hem şüphelinin ve hem de sanığın en önemli haklarının başında gelmektedir. Bu önemli kavramın evrimi ve modern kullanımı Kıta Avrupası ve Common Law hukuk sistemlerinde pek çok tartışmalara yol açmıştır. İşin ilginç yanı bu kavramın yaratıcısı olan Birleşik Krallık (İngiltere), şu anda bu hakkın özünü ortadan kaldırmaya calışmasıdır. Susma Hakkı ve anayasal hakların kullanımı ile ilgili en son önemli üzücü yorum Amerikan Yüksek Mahkemesi’nin ictihat degisikligi ile gelmistir. Elinizdeki bu analiz Türk Ceza Muhakemesi Sisteminde susma hakkının kullanımına uluslararası insan hakları sözleşmeleri, İngiltere ve Amerika Birleşik Devletleri gibi yabancı devletlerin ulusal hukuklarının öğretilerinin ve içtihat hukuklarının perspektifinden araştırma yapmayı amaçlamaktadır. Kendi coğrafi sınırları içerisinde ceza yargılaması yapma yetkisinin kullanan en özgürlükçü devletlerin bile en küçük fırsatta, insan hakları kavramlarını birey aleyhine sınırlandırmaya çalışmasını birey-devlet çelişkisi bağlamında Leviathan’in herzaman kontrol altında tutulması gerektiğini bizlere ispatlayan en önemli vasıtalardan birisidir.
