Academic Titles Compatible with Attorneyship

Öz

Attorneyship Code No. 1136, provides for basic rules of attorneyship law such as admission into the profession of attorney, rights and duties of an attorney, the organization of the bars and Turkey Bar Associations, attorneyship contract and legal aid. Attorneyship Code No. 1136 has been substantially changed by the enactment of the amendments of Act No. 4667, which came into force on May 2, 2001. Article 11 of the Attorneyship Code provides activities incompatible with attorneyship. According to this provision, services and duties rendered in exchange for payments such as a monthly salary, a fee, a daily wage, or dues; working as an insurance agent, a merchant, or a tradesman; and all activities not agreeing with the respectability of the profession are incompatible with attorneyship. There are some exceptions of this provision in the article 12 of the Attorneyship Code. According to this article, professorship and associate professorship in the field of law fall outside the scope of Article 11. However, before making amendments in the article 12 of the Attorneyship Code by the Code No. 4667, not only academic titles of professorship and associate professorship but also the academic title of assistant professorship was listed among the activities compatible with attorneyship. The Article 10 of the Constitution states that all individuals are equal without any discrimination before the law, irrespective of language, race, colour, sex, political opinion, philosophical belief, religion and sect, or any such considerations. Therefore, if any court asked the Constitutional Court to assess the compliance with the Constitution of Article 12,1/b of Code no. 1136 on Attorneys (as amended by Code no. 4667), it may be found to be unconstitutional in this regard. This provision must be changes in the new Attorneyship Code
