Ceza Muhakemesinde Müdafinin Konumu ve Uygulamada Karşılaşılan Sorunlar

Criminal procedure law is the branch of law that deals with the charge of providing justice and security of the society by judging the offenders in other words judging the individuals who are under suspicion of crime and penalizing whenever necessary. Criminal procedure law is merely a sharp sword of the government. The individual remains absolutely weak, incapable and defenceless in this field. The one who is virtual, who supports and helps the individual to defense him/herself is the defender. Thus, the rights, liberties and their enforcement provided for the defence and defender shows the system’s real face exactly. The position of the defence and defender functions as litmus paper for the political regime. This position shall be enact and enforce prudent. Within this scope, both the individual being defensed and the defender shall not feel themselves as fighting against the windmills as Don Quixote. In this legal study, normative structure of the defence and the defender in the scope of criminal procedure law is analyzed. Furthermore the challenges that are being revealed in practice are ascertained and it is tried to offer solutions in this analysis.

Ceza muhakemesi hukuku, devletin suç şüphesi altındaki bireyleri, yani failleri yargılayarak ve gerektiğinde ceza vererek toplumun adalet ve güvenliğini sağlama görevinin yerine getirilmesi ile uğraşan hukuk dalıdır. Ceza muhakemesi adeta devletin keskin kılıcıdır. İşte bireyin son derece güçsüz ve savunmasız kaldığı bu alanda, güçlü olan ve bireye destek verip savunmasında yardım eden ve bireyi güçlü devlete karşı tek başına bırakmayan kişi müdafidir. Bu nedenle savunmaya ve müdafie tanınan haklar, özgürlükler ve bunların uygulaması, içinde bulunulan rejimin gerçek yüzünü ortaya koymaktadır. Ceza muhakemesinde savunmanın ve müdafiliğin gerçek konumu, siyasi rejim için turnusol kağıdı işlevi görmektedir. Bu konum öyle düzenlenmeli ve uygulamaya geçirilmelidir ki, gerek savunma görevini yerine getiren müdafi, gerekse savunulan birey, kendilerini yel değirmenlerine karşı savaşan Don Kişot olarak hissetmemelidirler. Çalışmamızda ceza muhakemesinde savunma makamının ve müdafiliğin hem normatif yapısı incelenmekte hem de uygulamada ortaya çıkan sorunlar tespit edilerek bunlara çözüm önerileri getirilmeye çalışılmaktadır.
