TEBLİGAT KANUNU’NUN 20. MADDESİ ÜZERİNE DÜŞÜNCELER

In accordance with provision of The Notification Law notice is made to the last common address of acceptor (Article 10). However, for not the case of delay in the institutions within scope of legislation of notification which are obliged to enact, both in case of the absence on the behalf to whom made the notice and the case of the temporary estrangement about the particular regulations. In this study, the 20 th article of the Notification Law which became effective at 11.02.1959 and which regulates the temporary movement of the acceptor and the changes made in this article, is examined respectively. The current and expected locution of the article is explained with examining the reason and the results of the changes in the article. Our opinions and our preambles for those opinions are explained where the Supreme Court’s and the doctrine’s opinions are different.

Tebligat Kanunu hükümleri gereğince tebligatın muhatabına, bilinen son adresinde yapılması esastır (Teb. K. m. 10). Ancak Tebligat Kanunu kapsamında tebligat çıkarmak zorunda olan kurumların işlerinde gecikmeler olmaması için, muhatabın adresinde bulunmaması halinde yapılacak işlemlerle ilgili özel düzenlemeler yapılmıştır. Bu çalışmada 11.02.1959 tarihinde yürürlüğe giren Tebligat Kanunu’nun muhatabın muvakketen başka yere gitmesi halini düzenleyen 20. maddesi ve bu maddede yapılan değişiklikler sırasıyla incelenmiştir. Madde metninde yapılan değişikliklerin sebepleri ve sonuçlarının üzerinde durularak, olan ve olması gereken açıklanmıştır. Doktrin ve Yargıtay’ın farklı görüşlerinin olduğu alanlarda gerekçeleri belirtilerek görüşlerimiz belirtilmiştir.
