Kiralayanın Hapis Hakkı

Just like in the abrogated Code of Obligations Numbered 818, a legal lien has been established under the name “lien of landlord” concerning the lease of immovable properties in articles 336 to 338 of the Turkish Code of Obligations Numbered 6098. The lien of landlord differs from the general lien due to the character of its content deriving from material law and due to the fact that provisions pertaining to the law of enforcement would be implemented in the utilization of the right. In what concerns the scope of the lien of landlord, the Turkish lawmaker has deviated from the refer Switzerland Code of Obligations which continues to implement the lien of landlord only with regard to the lease of workplaces and has brought no restrictions. However, when the distrainable goods present in the residence and those among them that enter into the scope of the right of lien are evaluated together, the right of lien has become meaningless with regard to residence rentals. Thus, the refer Law should be followed-up and the Turkish Code of Obligations should be amended so as to also limit the right of lien with workplace rentals

6098 Sayılı Türk Borçlar Kanunu’nun 336 ila 338. maddelerinde, mülga 818 Sayılı Borçlar Kanunu’nda olduğu gibi, taşınmaz kirasında, “kiralayanın hapis hakkı” adı altında kanuni bir rehin hakkı düzenlenmiştir. Kiralayanın hapis hakkı, içeriğinin maddi hukuktan kaynaklanan niteliği ve hakkın kullanımı sırasında icra hukukuna mahsus hükümlerin uygulanacak olması nedeniyle genel hapis hakkından ayrılır. Kanun koyucu, kiralayanın hapis hakkının kapsamı konusunda, sadece işyeri kiraları bakımından uygulamayı sürdüren mehaz İsviçre Borçlar Kanunu’nda ayrılarak, bir sınırlamaya gitmemiştir. Fakat meskende bulunan haczi kabil mallar ve bunlardan hapis hakkı kapsamında olanlar birlikte değerlendirildiğinde, mesken kiraları bakımından hapis hakkı anlamını yitirmiştir. Bu nedenle mehaz kanun takip edilerek, Türk Borçlar Kanunu’nda da hapis hakkının sadece işyeri kiralarıyla sınırlandırılması yönünde değişikliğe gidilmelidir.
