Haksız Rekabet Hukukunda Başkalarının İş Ürünlerinden Yetkisiz Yararlanma (TTK m. 55/1-c)

As same in several sections of the Turkish Commercial Code with the number 6102, new and affirmative developments are included under the title of unfair competition. In the 55th provision of the Code particularly corresponding to 57th article of Turkish Commercial Code with the number 6762, it is obvious that an expansion has taken place in unfair competition in the light of frequently recurring cases in recent practice. When consulting the said unfair competition which is considered as exemplary, “unjustified utilisation from others’ business products” is confronted which is one of the clauses not issued in the previous Code. In this study, the new clause “unjustified utilisation from others’ business products” shall be discussed. The purpose of this study is to examine the scope of the clause and terms mentioned in the clause. Due to the new existence of the clause in Turkish law and also due to the poor existence in the Turkish law doctrine, mainly Swiss law shall be benefited from in the study

6102 sayılı Türk Ticaret Kanunu birçok kısımda olduğu gibi, haksız rekabet başlığı altında da yeni ve olumlu gelişmelere yer vermiştir. Kanun’un özellikle 6762 sayılı Türk Ticaret Kanunu m. 57’ye tekabül eden m. 55 hükmünde, uygulamada en sık karşılaşılan haksız rekabet hallerinde bir genişleme olduğu görülmektedir. Söz konusu örnek kabilinden sayılan haksız rekabet hallerine bakıldığında, önceki Kanun’da düzenlenmemiş bentlerden biri ‘başkalarının iş ürünlerinden yetkisiz yararlanma’ ile karşılaşılmaktadır. Bu çalışmada, yeni bent olan ‘başkalarının iş ürünlerinden yetkisiz yararlanma’ konusu ele alınacaktır. Çalışmanın amacı, adı geçen düzenlemeyi, bentte yer alan kavramları ve bendin kapsamını incelemektir. Bent Türk hukukunda yeni olması ve Türk hukuk doktrininde çok fazla yer bulmaması sebebiyle çalışmada esas olarak İsviçre hukukundan yararlanılacaktır.
