INDEPENDENCE AND IMPARTIALITY OF THE JUDICIARY IN OUR CONSTITUTIONS

Öz

Rule of law requires judiciary be independent than other state powers. Another important concept as well as independency of judiciary is impartiality of judiciary. The idea of judicial independence and impartiality is widely accepted among all countries in the world. In this article, firstly the meaning of judicial independence and impartiality is defined, and then the relationship of these concepts between the seperation of powers and the rule of law is examined. Following part of the article, judicial independence and impartiality, difficulties encountered in practise of these principles starting from the Constitution of 1876 up today is studied. The Constitution of 1876 sets forth very important regulations about independence and impartiality topics contrary to the Constitution of 1921. Regulations related to these topics in 1924 Constitution were both inadequate and unapllied. During the 1961 Constitution, judicial independence has been highly achieved, but the Constitution of the first version of 1982 had been taken step back again. Despite the achievement of beneficial regulations, which has vital impartance in the field of judiciary in the 2010 constitutional amendments, it is concluded that, concerning especially due to not electing members of Supreme Council of Judges and Prosecutors by legislature, these changes are staying behind the Constitution of 1961 with regard to democratic legitimacy of judicial power and also problems in practise to ensure independence and impartiality is observed.
