ERDOĞAN’IN “OTOLİMİTASYON DEKLARASYONU”, OHAL VE AKADEMİK ÖZGÜRLÜK

The night of July 15, 2016 was perhaps the longest night in the history of Turkey. Having survived the catastrophe, the Council of Ministers declared state of emergency throughout the country. In this article, a short assessment of the state of emergency declared after the coup d’eta attempt was done. Emphasis was given on the public pledges President Recep Tayyip Erdogan made and on the importance of constantly reminding the public of those pledges by political subjects. Additionally, the possible disastrous effect of the authority given to YOK to expel academics from public service despite being contrary to ordinary constitutional order processes following the declaration of Decree Law 667 and constitutional guarantees on academic freedom and the future of our universities.

15 Temmuz 2016 gecesi belki de Türkiye’nin “en uzun gecesi” olarak tarihe geçti. Önemli bir felaketin eşiğinden dönülmesinin akabinde 20 Temmuz 2016 günü Bakanlar Kurulu tarafından yurt çapında olağanüstü hal ilan edildi. Bu yazıda darbe girişimi sonrasında ilan edilen olağanüstü halin kısa bir değerlendirilmesi yapılmış; olağanüstü hal ilanıyla birlikte Cumhurbaşkanı Recep Tayyip Erdoğan’ın kamuoyuna deklare ettiği taahhütlerin ve bu taahhütlerin siyasal özneler tarafından gündemde tutulması ve sürekli hatırlatılmasının siyasal önemine dikkat çekilmiş ve OHAL ilanını takip eden 667 sayılı KHK’daki olağan dönem usullerine ve anayasal güvencelere aykırı bir biçimde YÖK’e tanınan öğretim elemanlarını kamu görevinden uzaklaştırma yetkisinin, akademik özgürlük ve üniversitelerimizin geleceği üzerine olası yıkıcı etkileri kısaca değerlendirilmiştir.
