Ceza ve Güvenlik Tedbirlerinin İnfazı Hakkında Kanun Kapsamında Bakıma Muhtaçlık Sürecinin Adli Tıp Kurumu Açısından Değerlendirilmesi

Öz

AMAÇ: Cezaevlerinde bulunan ve ağır hastalık, sakatlık veya kocama nedeniyle hayatını yalnız idame ettiremeyen hükümlülerin tahliyelerini düzenleyen kanun maddelerinde, bu kişilerin tıbbi durumlarının Adli Tıp Kurumu tarafından tespit edileceği veya tam teşekküllü bir hastaneden alınan raporun Adli Tıp Kurumu tarafından onaylanması gerektiği belirtilmektedir. Bu çalışma ile Ceza ve Güvenlik Tedbirlerinin İnfazı Hakkında Kanunun 105/A 3-b ve 16/6.maddesi kapsamındaki yeni düzenlemeyle cezaevlerinde hastalıkları nedeniyle hayatını yalnız idame ettiremeyen mahkûm hastaların Adli Tıp Kurumu tarafından değerlendirilmesi, kapsam dâhilindeki olgulardaki kriterlerin belirlenmesi ve sunulması amaçlanmıştır. YÖNTEMLER: Bu kapsamda 31 Ocak 2013-31 Temmuz 2013 tarihleri arasındaki 6 aylık süreçte Adli Tıp Kurumu 3. Adli Tıp İhtisas Kuruluna mevcut hastalığı nedeniyle cezasının ertelenip ertelenemeyeceği, erken tahliye edilip edilemeyeceği veya af kapsamında olup olmadığı sorulmak üzere gönderilen olgular retrospektif olarak incelenmiş ve hayatını yalnız idame ettiremeyeceği kararı verilen olgular tespit edilmiştir. BULGULAR: Adli Tıp Kurumunda raporları düzenlenen 765 olgu içerisinden hayatını yalnız idame ettiremeyen; 105/A 3-b maddesi kapsamında değerlendirilen 9 olgu ve 16/6 maddesi kapsamında değerlendirilen 87 olgu tespit edilmiştir. SONUÇ: Cezaevinde bir başkasının bakımına muhtaç olan kişilerin durumu hızla çözüm gerektirmektedir. Çözümün gecikmesi kişilerin hastalıklarının ilerlemesine, cezaevinde istenmeyen kaza veya komplikasyonlara neden olabilir. Bu nedenle sağlık kuruluşları tarafından düzenlenen kararlarda kişide bakıma muhtaçlık gerektirir bir hastalık tespit edilmediği durumlarda bu kişiler için Adli Tıp Kurumu sevkine gerek olmadığının belirtilmesi, bakıma muhtaçlık gerektirir hastalık tespit edilen durumlarda ise kişinin tüm tıbbi evrakı ile en kısa sürede Adli Tıp Kurumuna sevkinin sağlanması önem arz etmektedir.

Evaluation of Nursing Neediness Process as a Part of the Law on the Execution of Sentences and Security Measures in Terms of the Council of Forensic Medicine

Öz

OBJECTIVE: According to the articles of law which regulates the release of the convicts who needs nursing due to serious illness, disability or senility; the medical situation of convicts must be determined by the Council of Forensic Medicine or the reports taken from General Hospitals should be approved by the Council of Forensic Medicine. Purpose of this study is to present the evaluation of the prisoners who are considered incapable of living alone and need nursing in terms of the articles 105/A 3-b and 16/6 of the law on the Execution of Sentences and Security Measures by the Council of Forensic Medicine, to define the criteria of these cases and to present the criteria. METHODS: Within this scope, reports of 3rd Specialization Board, which were sent between 31.01.2013 and 31.07.2013 to be asked whether the execution of the sentence should be delayed, early release of a convict or medical parole can be possible, were investigated retrospectively and those who were decided to be in need of nursing were determined.RESULTS: Out of 765 reports, 9 cases which were evaluated in the context of the article 105 A3-b and 87 cases which were evaluated in the context of the article 16/6 were determined.CONCLUSION: The situations of prisoners who are considered incapable of living alone and need nursing require a fast solution. Delay of the solution causes the progression of the diseases as well as accidents or complications. Therefore; if the hospitals cannot detect any diseases that requires nursing than they should indicate the referral of the prisoner to the Council of Forensic Medicine is not necessary, though if hospitals detect a disease which requires nursing than the prisoners should be referred to the Council of Forensic Medicine with all medical document within the shortest time.
