Epilepsi ve ceza sorumluluğu: Olgu sunumu

Öz

Epilepsi, insanlık tarihinin bilinen en eski ve en sık görülen nörolojik hastalıklarından birisidir. Epilepsi hastalığı olan kişilerde, suç işleme eğiliminin de genel topluma göre daha sık olduğuna inanılmaktadır. Bu nedenle, yargı makamları tarafından epilepsi hastalığı ile ilgili olarak failin suça karşı ceza sorumluluğunun olup olmadığı hususunda adli psikiyatrik değerlendirme yapılması istenmektedir. 26 yaşındaki erkek olgu, farklı tarihlerde işlediği üç hırsızlık suçuna karşı ceza sorumluluğu yönünden değerlendirilmek amacıyla kliniğimize gönderilmiştir. Alınan öyküde; olgunun 16 yaşında epilepsiye yönelik operasyon geçirdiği, daha önce 13 hırsızlık ve bir kasten yaralama suçu işlediği, eski suçları nedeniyle halen cezaevinde bulunduğu öğrenilmiştir. Her üç suçu sonrasında alınan ifadelerinde olayı detaylı olarak anlatan olgu, kliniğimizdeki görüşme sırasında; daha önce adli bir olayının olup olmadığını bilmediğini, sorulan hırsızlık olaylarının hiç birini hatırlamadığını, diğer suçlarını da hatırlamadığını, buraya neden geldiğini bilmediğini belirtmiştir. Psikiyatrik muayenesinde; halen psikopatolojik bulguya rastlanmadığı, görüşme süresince belirgin hekimi aldatıcı davranış simülasyon girişiminde bulunduğu belirlenmiştir. Kliniğimizce düzenlenen raporlarda, kişinin söz konusu suçlarına karşı ceza sorumluluğunun tam olduğu yönünde görüş bildirilmiştir Yazımızda; epilepsi hastalığını kullanarak hekimi aldatıcı davranış simülasyon girişiminde bulunan söz konusu epilepsi olgusu sunularak, epilepsi olgularında ceza sorumluluğunun tartışılması amaçlanmaktadır.

Epilepsy and assessment of criminal responsibility: A case report

Öz

Epilepsy is one of the oldest and most common neurological diseases known in human history. It is speculated that individuals diagnosed with epilepsy are more liable to conduct criminal behavior compared to general population. For this reason, judicial authorities are required to conduct a forensic psychiatric evaluation to determine whether an offender has a responsibility for his/her own criminal behaviour. A 26-year-old male case was sent to our clinic for evaluation of criminal responsibility against three theft crimes committed on different dates. It was stated in the case history that he had undergone surgery for epilepsy disease at the age of 16, had previously committed 13 theft and one deliberate wounding crime and, was still in prison for the crimes he had committed in past. According to the documents, after each of the three misconducts and criminal activity, the case was able to describe the modus operandi of his criminal attempts in detail. However, during the interview in our clinic; he told that he did not know whether he had been involved in a criminal activity before, adding that he did not remember neither of the three theft cases nor the other misconducts. He also said that he did not know why he was brought here. In the psychiatric examination; psychopathological findings have not been encountered yet and there was a significant malingering attempt during the interview. In our clinic reports, it was suggested that the case has full criminal responsibility in all of the three crimes. In this illustration; it is aimed to discuss the criminal responsibility in cases of epilepsy by presenting this case which is the subject of simulation attempt using epilepsy disease.
