Özel Hayatın Kapsamı: Avrupa İnsan Hakları Mahkemesi İçtihatları Işığında Bir Değerlendirme

Öz

Özel hayat ile ilgili olarak en çok dile getirilen şikâyet, bu kavramın tanımlanmasının zorluğuna ve kapsamının belirsizliğine ilişkindir. Birçok uluslararası ve ulusal belgede özel hayatın gizliliği hakkının tanınmasına rağmen tanımlanmaması bunun en açık göstergesidir. Özel hayatın gizliliği hakkını tanıyan ama tanımlamayan uluslararası belgelerden biri olan Avrupa İnsan Hakları Sözleşmesinin uygulayıcısı konumundaki Avrupa İnsan Hakları Mahkemesi de birçok kararında “Mahkeme, özel hayat kavramının tam olarak tanımlanmasının mümkün olduğu ya da böyle bir gayretin gerekli olduğu kanaatinde değildir.” diyerek onu tanımlamaktan kaçınmıştır. Bunun yerine verdiği kararlarla özel hayatın kapsamını belirlemiştir. Buna göre; kişinin adı, soyadı, cinsiyet kimliği, etnik kimliği, yaşam biçimi, görüntüsü, onur ve şöhreti, fi ziksel ve psikolojik bütünlüğü, cinsel hayatı ve kişisel verileri özel hayata dâhil hususlar içinde yer alır.

Öz

Private life is a complex and broad concept, so it is diffi cult to defi ne it and determine its scope. For this reason it is not defi ned although it is recognized as a human right in many national and international documents. For instance, The Universal Declaration of Human Rights and European Convention on Human Rights recognizes the right of private life but doesn’t defi ne it. Human Rights Court has also never offered a clear and precise defi nition of what is meant by private life. Because “the Court does not consider it possible or necessary to attempt an exhaustive defi nition of the notion of private life.” Instead, the Court determined the scope of private life by judgments. According to the Court’s case law, private life covers name, surname, gender and ethnic identifi cation, lifestyle, image, honour and reputation, personal data, physical and moral integrity and sexual life
