Öz

The purpose of the study is to present the analysis of the reflections of the developing and transforming war technologies on the law of war. With the development of technology, it is witnessed that artificial intelligence products and autonomous systems are frequently used. One of the usage area of autonomous systems is military and defense. The use of autonomous systems in defense is controversial. Because it is not clear how it will affect the laws of war. In this context, questions have arisen about the effect of autonomous systems on the law of war. For example, does it change the laws of war? How does it affect the law of war?
After the literature review, the effect of autonomous systems on the law of war will be discussed. Conflict law has bound the conflict to certain rules. But there is concern whether it will connect autonomous systems. There is no consensus on what autonomous systems are. The lack of consensus has raised concerns, with the increasing use of autonomous systems.

OTONOM SİSTEMLERİN SAVAŞ VE SAVAŞ HUKUKUNA ETKİSİ

Öz

Çalışmanın amacı, gelişen ve dönüşen savaş teknolojilerinin savaş hukukuna yansımalarının analizini sunmaktır. Teknolojinin gelişmesiyle yapay zekâ ürünlerinin ve otonom sistemlerin her alanda sıklıkla kullanıldığına şahit olunmaktadır. Bahsi geçen sistemlerin kullanıldığı alanlardan biri de askeri ve savunma alanıdır. Otonom sistemlerin bu alanlarda kullanılması savaş hukukuna nasıl etki edeceği tartışma konusu haline gelmiştir. Bu açıdan bakıldığında yapay zekâ teknolojilerinin askeri alanlarda ya da sıcak çatışma bölgelerinde kullanılması savaş hukukuna nasıl etki eder, savaş hukukunu değiştirir mi ya da değiştirme gücüne erişir mi sorularının altının çizilmesi gerekmektedir.
Bu bilgiler ışığında çalışma dahilinde gerekli literatür taraması çerçevesinde otonom sistemlerin savaş hukukuna etkileri tartışılacaktır. Uluslararası çatışma hukuku çatışmayı belirli kurallar çerçevesinde ele alsa da değişen konjonktür otonom sistem karşıtı gruplarda belirsizlik ve endişe yaratmaktadır. Otonom sistemlerin ve kapsamının ne olduğu konusunda bir konsensüs bulunmadığından bu sistemleri uluslararası çatışma hukuku kuralları çerçevesinde değerlendirme ve ele alma konusunda eksiklikler ortaya çıkmaktadır. Örneğin çatışma hukukuna göre taraflar çatışma yöntemlerini seçme konusunda tam özerkliğe sahip değildir. Ancak otonom sistemlerin yasaklanan çatışma silah ve yöntemleri arasında kabul edilip edilmeyeceği konusu net değildir.
