Basic rights and liberties are divided into three groups; rights of status
negativus rights of status positivus rights of status activus. Rights have integral
and supportive qualifications to each other by nature.
Rights vary according to content they have and difference of authority
which protects this content. A distinction is revealed between public law and
private law moving from a dissection which considers right as a benefit which
is guaranteed by law.
The state, which secured first generation rights arising from individual’s
existence, expanded right range by moving ahead of this security with changing
and developing social life and gave second generation rights which are about
social and economic existence of individual.
This study aims to find out the position of second generation right against
first generation rights and to what extend these rights are directly claimable by
the individual when social and economic rights of individual, which organize
second generation rights case, are analyzed by taking into consideration systems
which are followed for rights of integrity principle and using rights.
