The African Court on Human and Peoples’ Rights: the story of a repressed Court

Öz

Bu makale, Afrika İnsan ve Halkların Hakları Mahkemesinin bölgesel bir yargı organı olarak kabul görene kadar geçen uzun yolculuğunu izlemektedir. Kıtada Pan-Afrikancılık vizyon ve hedeflerinin somutlaştırılmasını amaçlayan umut verici kuruluşuna rağmen, mahkemenin kurumsal ve operasyonel yönü geride kalmış görünmektedir. Makale, mahkemenin kuruluş sürecinin, tasarımını ve işleyişini etkileyen artan bir baskı altında gerçekleştiğini savunmaktadır. Makale, mahkemenin kuruluş belgeleri olan Ouagadougou Protokolü'nün zorlu taslak hazırlama sürecini, mahkemenin kurulmasını etkileyen siyasi baskılar ve devletlerin direnişine odaklanarak izlemektedir. Çalışma ayrıca, Afrika Mahkemesi'nin yanı sıra diğer mahkemelerin ve yargı organlarının giderek artan varlığıyla bu baskının nasıl yoğunlaştığını, dolayısıyla mahkemenin görünürlüğünü sınırladığını ve gelişimini engellediğini incelemektedir.

Afrika İnsan ve Halkların Hakları Mahkemesi: İstenmeyen bir mahkemenin hikâyesi

Öz

This paper traces the long journey of the African Court on Human and Peoples’ Rights to acceptance as a regional judicial organ. Although its promising establishment, aiming for a concretization of Pan-Africanism visions and objectives within the continent, the institutional and operational side of the court seems to be lagging behind. The paper argues that the Court’s genesis had come under increased pressure which affected its design and its functioning. It traces the arduous process of drafting the Court’s founding documents, the Protocol of Ouagadougou, focusing on the political pressures and resistance from states that influenced its creation. The study also examines how this pressure was intensified by the increasing emergence of other courts and tribunals alongside the African Court, limiting therefore the Court's visibility and hindering its development.
