DISCIPLINARY DIALOGUES AND LEGAL CLINICS-EXAMPLE OF PROBLEMS OF AGRICULTURE, FOOD AND THE RIGHT TO FOOD AND NUTRITION LEGAL CLINIC

Öz

Legal clinic model is frequently used today due to its contributions to legal education in various ways. One such contribution is their incorporation of methods that facilitate discussions from different areas of expertise within legal education. The first section of this paper will present a general framework of the legal clinic model, while the second section will explore the meaning of implementing legal clinics with contributions from different disciplines through the concepts of multidisciplinarity, interdisciplinarity and transdisciplinarity. Based on the idea that perspectives from different fields are needed to reveal the multidimensional structure and requirements of the fundamental right to food and nutrition, “Problems of Agriculture, Food, and the Right to Food and Nutrition Legal Clinic” organized at Ankara University Faculty of Law will be discussed to explore the possibility of incorporating such disciplinary dialogue into legal education for many fundamental rights in the second section. Through this experience, it will be discussed whether a legal clinic model created using such a method, via examining the gains and limitations of this application, is functional in raising awareness among law school students about a certain fundamental right and the issues surrounding it.

Disipliner Diyaloglar ve Hukuk Klinikleri - Tarım, Gıda ve Beslenme Hakkı Sorunları Hukuk Kliniği Örneği

Öz

Hukuk klinikleri, hukuk eğitimine çeşitli yönlerden sunduğu katkılar nedeniyle, günümüzde kendisine sıkça başvurulan bir modeldir. Farklı uzmanlık alanlarının tartışmalarının hukuk eğitimine dahil edilmesini sağlayan metotlar içeriyor oluşu da bu katkılar arasında yer alır. Bu çalışmanın iki ana bölümünden ilkinde, hukuk klinikleri modeli hakkında kısa ve genel bir çerçeve sunulacak; hukuk kliniklerinin disipliner etkileşimle gerçekleştirilmesinin anlamı multidisiplinerlik, disiplinlerarasılık (interdisiplinerlik) ve transdisiplinerlik kavramları aracılığıyla ortaya konmaya çalışılacaktır. Bir temel hak olan beslenme ve gıda hakkının çok boyutlu yapısının ve gereklerinin ortaya konabilmesi için farklı alanlardan bakış açılarına ihtiyaç olduğu düşüncesinden hareketle, makalenin ikinci bölümünde, diğer temel haklara da böylesi bir disipliner diyalogla hukuk eğitiminde yer verme imkânını tartışmak amacıyla, Ankara Üniversitesi Hukuk Fakültesinde yürütülmüş olan “Tarım, Gıda ve Beslenme Hakkı Sorunları Hukuk Kliniği” örneği deneyimi incelenecektir. Çalışmanın temel tartışma konusu, disipliner diyaloğun, hukuk klinikleri modeline bir yöntem olarak entegre edilmesinin getirdiği kazanımlar ile kısıtlılıkların, beslenme ve gıda hakkı örneği üzerinden incelenmesidir. Söz konusu uygulama örneği aracılığıyla, hukuk fakültesi öğrencilerinde beslenme ve gıda hakkı ile etrafındaki sorunlar hakkında farkındalık oluşturulmasında, böylesi bir yöntemle oluşturulan bir hukuk kliniği modelinin işlevsel olup olmadığı tartışılacaktır.
