AVRUPA TOPLULUĞUNUN MİLLETLERARASI ÖZEL HUKUK ALANINDA ULUSLARARASI ANLAŞMA AKDETME YETKİSİ VE C-01/03 SAYILI VE 7 ŞUBAT 2006 TARİHLİ AVRUPA TOPLULUKLARI ADALET DİVANI GÖRÜŞÜ

Öz

Avrupa Topluluğunun milletlerarası özel hukuk alanında üçüncü devletler ve uluslararası örgütlerle uluslararası anlaşma yapma yetkisinin niteliği, son yıllarda sıklıkla tartışmalara konu olmuş; tartışmaların merkezini ise, Hukukî ve Ticarî Konularda Yargı Yetkisi ve Yargı Kararlarının Tenfizine Dair 16 Eylül 1988 tarihli Lugano Konvansiyonunun yenilenmiş şeklinin imzalanması konusunda Avrupa Topluluğunun münhasıran yetkili olup olmadığı sorusu teşkil etmiştir. Avrupa Birliği Konseyi tarafından bu soruya ilişkin olarak Avrupa Toplulukları Adalet Divanına yapılan başvuru, başvuru tarihinden ancak üç yıl sonra sonuçlanabilmiştir. Divanın yeni Lugano Konvansiyonunun Avrupa Topluluğu tarafından imzalanması konusunda açıkladığı görüşü, sadece söz konusu Konvansiyonun imzalanması bakımından değil, aynı zamanda gerek Topluluğun münhasır yetkisine dair Divan içtihadında gelinen nokta, gerekse Avrupa Topluluğunda milletlerarası özel hukuk alanındaki gelişmeleri etkilemesi bakımından önem taşımaktadır

Öz

The competence of the European Community on the conclusion of international agreements in the field of private international law has been subject to much comment in recent years. Discussions have centered on the question of whether the European Community has exclusive competence on the conclusion of the revised version of the Lugano Convention of 16 September 1988 on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters. The Council of the European Union has applied to the Court of Justice of the European Communities for an opinion, which could only be declared after three years. The Lugano Opinion is significant, not only in solving the problem of the conclusion of the new Lugano Convention by the European Community, but also regarding jurisprudence of the Court of Justice on the exclusive external Community competence and the future developments in the field of European private international law
