Öz

ABD adalet sistemi dünyadaki eşsiz sistemlerden birisidir ve Amerika dünyanın en gelişmiş yargı sistemlerinden birine sahip olması ile ünlüdür. Bu sistem fedaral sisteme bağlı olarak, eyalet ve federal mahkeme örgütlenmesi olmak üzere iki ayrı ve birbirine tamamlayan sisteme sahiptir. Amerikan hukuk sistemi İngiliz hukuk sistemi mirasının bir parçasıdır ve adversarial adalet sistemine dayanmaktadır. Birleşik Devletler ikili mahkeme teşkilatına sahiptir. Her bir teşkilat yetkisini Anayasa ve kanunlardan almaktadır. Eyaletler kendi mahkeme teşkilat modellerini oluşturma konusunda yetkili olmakla birlikte, eyalet adalet sistemleri ve mahkeme yapılanmaları ortak yönler taşımaktadır. Amerikan mahkeme teşkilatı sisteminin ortak yönleri; ikili mahkeme teşkilatına sahip olması, sistemin rekabeti ön planda tutması, sistemin esnek olması ve yerel değerlere önem vermesidir. Bu makalede, eyalet ve federal mahkeme yapılanması irdelenmiş, Amerikan mahkeme yapılanmasının temel özellikleri belirlenmeye çalışılmış ve bunların Türkiye bakımından uygulanabilirlikleri üzerinde durulmuştur

Organization of the United States Court

Öz

The justice system in the United States is one of the most unique in the world and the US is renowned for having one of the most sophisticated judicial systems. It consists of two separate levels of courts, state and federal, that can peacefully co-exist under the concept of federalism. The U.S. legal system is in part inherited from English common law and depends on an adversarial system of justice. The United States has a "dual court system" consisting of state courts that primarily hear civil and criminal cases related to state laws and state constitutional issues, and federal courts that primarily hear civil and criminal cases related to federal laws, US treaties and the US Constitution. Although each state is free to organise its own court organization, most states justice systems have several features in common. Important features of the federal and state level organization of the American court; have a dual court system, system to keep at the forefront of the principles of competition, have flexible structures in the system and the protection of local values. İn this article examined the federal and state court system, tried to determine the basic features of the American courts organization and examined the applicability of the system in relation to Turkey
