The Issue of charging a fee against Letter of Guarantee between AAOIFI Standard and Pronouncements of Kuwait Finance House
Abstract
This research addresses the issue of the permissibility of taking the fee in exchange for a letter of guarantee, by mentioning the sayings of the jurists of the Islamic schools, in addition to the sayings of the contemporary jurists, compared to the fatwas of Kuwait Finance House and the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI), in addition to the extent of the permissibility of taking the fee in exchange for a usurious letter of guarantee. The researcher followed the descriptive approach by studying the issue of taking the fee for the guarantee and its letter, and the analytical approach through analyzing the sayings of the jurists. The researcher reached, through his study, to a conclusion there is no objection to take the fee in exchange for the letter of guarantee, provided that there are real banks provided by the issuing authority for a letter of guarantee.
